Position Overview

The Law Clerk in the Estates Litigation department plays a crucial role in the evaluation and management of legal files. This position requires a thorough review of case facts, identification of key issues, and the planning of necessary steps to ensure effective file conduct while adhering to critical deadlines.

Key Responsibilities
  • Drafting essential legal documents including pleadings, applications, affidavits, and correspondence in compliance with relevant legislation and regulations.
  • Engaging with clients to gather necessary information, provide updates on file status, and address any inquiries or concerns within the designated authority.
  • Assisting in various matters related to estate administration, including guardianships, will challenges, power of attorney disputes, and trust variations.
  • Beginning to mentor and guide junior staff within the department, fostering their professional development.
  • Conducting research and analysis on legal issues, processes, case law, and applicable legislation.
  • Initiating follow-up actions as required to ensure progress on client files.
  • Communicating with service providers, judicial officials, and financial institution representatives regarding client matters.
  • Preparing reports as necessary and undertaking additional duties as assigned.
Qualifications

The ideal candidate will possess:

  • Completion of an accredited Law Clerk program with practical experience in estate litigation.
  • Strong communication skills, with the ability to address client needs professionally and courteously.
  • Proficiency in legal research and document analysis, ensuring accuracy and relevance.
  • A developing ability to coach and mentor junior law clerks.
  • Capability to produce high-quality work under tight deadlines while managing stress effectively.
  • Excellent time management and organizational skills.
  • A solid understanding of the Rules of Civil Procedure.
  • Self-motivation and the ability to work independently in a remote setting.
  • Exceptional technical skills, including proficiency in MS Office Suite, Expert Time, iManage, and WindUp.
  • Familiarity with document management software such as Relativity is advantageous.
  • A basic understanding of related legal areas, including real estate and commercial law, is a plus.
  • A Certificate in Estate and Trust Administration (CETA) is considered an asset.
