The Commercial, Police & Regulatory Prosecutions (CPR) section practices in diverse areas of the law, with conduct of serious, complex, or lengthy cases that require special knowledge and expertise. CPR prosecutes cases throughout BC.

**Generally, CPR files may involve**:

- Pre-charge advice
- Disclosure and information-sharing issues
- Complex legal issues
- Relationships of trust, vulnerability, or authority between perpetrators and victims
- Concurrent regulatory, administrative or civil proceedings
- Corporate offenders
- Multiple jurisdictions
- High profile cases
- Significant public interest considerations

**The areas within CPR’s mandate are**:

- Prosecutions focused on business, finance, commerce, money laundering, proceeds of crime, or forfeiture;
- Conduct of police files referred by the Independent Investigations Office and other agencies including police misconduct that results in death or serious harm or breach of trust allegations;
- Management and conduct of Criminal Code prosecutions or regulatory prosecutions under provincial statutes, including occupational health and safety (such as serious workplace injuries or fatalities), environmental, animal welfare and securities prosecutions, and other regulatory areas that warrant quasi-criminal prosecution.

CASP is a division of the BC Prosecution Service (BCPS). The BCPS contributes to the protection of society by preparing for and conducting prosecutions diligently and fairly, and by striving to develop the most effective methods to administer justice in the Province. The BCPS prosecutes offences under the Criminal Code of Canada, the Youth Criminal Justice Act, and provincial statutes in the Provincial, Supreme and Appeal Courts of British Columbia and in the Supreme Court of Canada. The BCPS provides legal advice to government and police on criminal law matters, and develops policies and procedures on issues relating to the prosecution of criminal justice. The Assistant Deputy Attorney General is responsible for the administration of the BCPS, which is divided into the Office of the Assistant Deputy Attorney General, Criminal Appeals and Special Prosecutions and five regions which are headed by a Regional Crown Counsel.

**CASP is responsible for the following areas of practice**:
(1) all indictable criminal appeals undertaken to the Court of Appeal for British Columbia and the Supreme Court of Canada, [Criminal Appeals Section];
(2) prosecutions involving commercial crime, allegations against police and regulatory offences including environmental and workplace injury and fatality related prosecutions [Commercial, Police, & Regulatory Prosecution Section];
(3) organized and major crime prosecutions;
(4) CASP is also responsible for providing prosecutorial litigation support to other prosecution offices within the BCPS in respect of constitutional challenges that arise in the trial courts [Prosecution Support Unit];
(5) CASP is also responsible for the delivery of legal resources and learning and development opportunities for the BCPS.
(6) CASP is also responsible for coordinating French and bilingual prosecutions

**Job Requirements**:
**Education**:

- Juris Doctor or Bachelor of Laws Degree from an accredited common law school.
- Membership in good standing in the Law Society of British Columbia or membership in good standing in another Canadian Law Society and immediately eligible to become a member of the Law Society of British Columbia. **PLEASE INCLUDE YOUR CALL DATE.**

**Experience**:

- **Crown Counsel Leve 1**:Counsel in their 1st to 5th year of call, with a minimum of 3 years' recent experience as a called and practicing lawyer in Canada with a primary focus in the area of criminal law or reasonably comparable quasi-criminal law and/or regulatory law experience.
- **Crown Counsel Level 2**: Counsel in their 6th to 11th year of call, with a minimum of 3 years’ recent experience as a called and practicing lawyer in Canada with a primary focus in the area of criminal law or reasonably comparable quasi-criminal law and/or regulatory law experience.
