Key Responsibilities:

  • Case Management: Oversee personal injury files from intake to resolution, including conducting client meetings, assessing claims, and developing case strategies.
  • Legal Research & Drafting: Prepare pleadings, motions, mediation briefs, settlement proposals, and other legal documents, while conducting thorough research on liability, damages, and procedural issues.
  • Advocacy & Litigation: Represent clients in negotiations, mediations, discoveries, pre-trial conferences, and court hearings, appearing before the Ontario Superior Court of Justice and tribunals as needed.
  • Client Relations: Maintain strong communication with clients, keeping them informed throughout the litigation process and providing strategic legal advice.
  • Negotiation & Settlement: Engage in settlement discussions with insurance companies and opposing counsel to achieve favorable outcomes for clients.
  • Trial Preparation & Advocacy: Prepare cases for trial, including working with experts, drafting trial materials, and representing clients in court when necessary.
  • Team Collaboration: Work closely with senior lawyers, clerks, and support staff to efficiently manage files and meet deadlines, providing mentorship to junior associates and articling students as needed.

Types of Files:

  • Motor Vehicle Accidents (MVA): Represent clients in claims involving bodily injuries, catastrophic impairments, and accident benefits disputes.
  • Occupiers' Liability: Advocate for individuals injured due to slip and falls, trip and falls, and other premises-related accidents.
  • Product Liability: Handle claims involving defective or dangerous products that have caused injury.
  • Medical Malpractice: Assist clients in pursuing claims against healthcare providers for negligence or substandard care.
  • Disability Claims: Represent clients in long-term and short-term disability disputes against insurance companies.
  • Municipal Liability: Handle cases involving injuries caused by poorly maintained roads, sidewalks, or municipal properties.
  • Dog Bite and Animal Attack Claims: Assist clients in seeking compensation for injuries caused by animals.

Qualifications:

  • Minimum of 5 years of experience practicing personal injury law, with a strong understanding of tort and accident benefits claims.
  • Proven advocacy skills, including experience with discoveries, motions, mediations, and hearings.
  • Excellent drafting, negotiation, and communication skills.
  • Ability to independently manage files while working collaboratively within a team environment.
  • Strong analytical and problem-solving abilities to assess legal issues and develop case strategies.
  • Experience dealing with medical and liability experts is an asset.
  • Familiarity with case management software and Microsoft Office Suite.

Education & Licensing:

  • LL.B. or J.D. degree.
  • Member in good standing with the Law Society of Ontario.
