OVERVIEW

JOB PURPOSE:

The Forensic Auditor serves as a key Accounting Specialist responsible for the thorough and timely examination of various issues concerning the professional behavior and competency of legal practitioners and paralegals, referred to as "licensees." This role aligns with the Law Society's commitment to public interest, adhering to relevant legislation, by-laws, and internal policies. The position entails independent planning, execution, and conclusion of investigations, employing forensic accounting methodologies to identify potential violations of the Society's regulations, particularly in areas such as mortgage fraud, estate management, conflicts of interest, and other pertinent matters. The Forensic Auditor also provides expert testimony in legal settings and may initiate practice controls during investigations.

QUALIFICATIONS REQUIRED:

  • A university degree or equivalent training and experience, complemented by a professional accounting designation and membership in a recognized Canadian accounting body.
  • A minimum of five (5) years of forensic experience, ideally within a regulatory framework, is essential for assessing complex financial transactions against stringent regulatory accounting standards.
  • Experience in forensic investigations focusing on real estate and mortgage fraud is advantageous.
  • Regular travel to licensees' offices is required, with occasional overnight stays during investigations.
  • A comprehensive understanding of the Law Society's mandate, services, legislation, and policies is necessary.
  • In-depth knowledge of contemporary trends and practices in accounting and forensic investigation techniques is expected.
  • Familiarity with various dispute resolution methods and their appropriate applications is important.
  • Strong verbal and written communication skills are essential for evidence collection and facilitating the resolution of complaints.
  • Exceptional writing abilities for preparing a wide range of investigative documents and memoranda are required.
  • Analytical skills to interpret complex spoken and written information are crucial.
  • Proficiency in computer applications, including word processing, advanced spreadsheet functions, and accounting software, is necessary.
  • A broad understanding of technology applications in a regulatory or legal context is preferred.

KEY ACCOUNTABILITIES

Client / Customer Service Delivery

  • Conducts investigations into serious and complex matters, including professional misconduct, competence, licensing, and unauthorized practice.
  • Independently plans and executes investigative assignments, providing recommendations for case resolutions.
  • Identifies risks and performs ongoing risk assessments.
  • Applies forensic auditing principles to investigate allegations of misuse of client property.
  • Develops case files that meet prosecutorial and evidentiary standards, including investigation reports and expert witness documentation.
  • Assesses and recommends resolutions for investigation files, including practice controls and license revocation.
  • Identifies candidates for remedial initiatives and seeks opportunities for alternative dispute resolution.
  • Assists legal counsel in preparing cases for hearings and provides testimony as needed.
  • Adheres to procedural requirements for evidence handling and prepares witness statements.
  • Prepares reports for the Proceedings Authorization Committee regarding non-discipline recommendations.
  • Creates comprehensive investigative reports that include key supporting documents.
  • Supports legal counsel in case preparations and testifies in court as required.

Policy / Regulatory Compliance

  • Examines accounting records maintained by licensees to ensure compliance with relevant rules and regulations.
  • Follows established procedures for searches and evidence handling during forensic investigations.

Performance Goals, Targets and Standards

  • Contributes to the development of standardized practices and guidelines for conducting investigations.
  • Manages own caseload while collaborating with the Investigation Services Department to enhance processes and performance targets.

Policy Development

  • Continuously evaluates policies and procedures, identifying opportunities for development or change related to investigative activities.
  • Participates in policy development as assigned.

Team Membership

  • Encourages knowledge sharing among members of the Investigation Services Department.
  • Acts as an expert witness and advisor in forensic audit cases.

WORKING ARRANGEMENT

The Law Society has implemented a Distributed Workforce Model to enhance flexibility and productivity. The working arrangement for this position is primarily remote, with occasional office attendance as required.
