Senior Counsel for Information Governance

The City of New York is introducing a pivotal role of Senior Counsel for Information Governance within our Ethics and Compliance Division. This attorney will oversee the agency's adherence to the New York State Freedom of Information Law (FOIL) and the New York City Identifying Information Law, serving as the designated Records Access Officer.
The Senior Counsel will be tasked with receiving, monitoring, and interpreting information requests directed to the Law Department in accordance with FOIL. This includes collaborating with various departmental staff to locate, retrieve, and evaluate documents that may respond to these requests. The attorney will analyze the extent of information that must be disclosed and determine if any information can be withheld, subsequently issuing decisions to requesters. Additionally, they will support the Records Appeals Officer in FOIL appeal evaluations and provide guidance to the General Litigation Division regarding FOIL-related Article 78 defenses. Training and advising City clients on FOIL law, practices, and pertinent legal updates will also be part of their responsibilities.
Furthermore, the Senior Counsel will fulfill the duties of an 'Agency Privacy Officer' under the Identifying Information Law. Key responsibilities include ensuring daily compliance across all divisions of the Department, advising staff on privacy matters, approving projects or contracts involving the collection or disclosure of identifying information, and preparing quarterly reports for the City's Chief Privacy Officer. They will also draft the agency's biennial report on the collection, disclosure, and retention of identifying information, as well as investigate privacy incidents within the Department or involving third-party contractors. The Senior Counsel will participate as a member of the Citywide Privacy Protection Committee, coordinated by the Office of Information Privacy.
After completing orientation, attorneys appointed by the Law Department may choose to work remotely under one of two available programs. The first option permits limited and irregular remote work, while the second option is a Citywide pilot program allowing participants to designate two specific days each week for remote work, subject to division approval and operational needs. If an attorney has court appearances or client meetings on a designated remote work day, they must fulfill those in-person obligations. Participants in the pilot program must establish a consistent remote work location.
Minimum Qualifications
Applicants must hold a degree from an ABA-accredited law school and be admitted to the New York State Bar in good standing, with a minimum of one year of post-law school legal experience. While experience with litigation and/or FOIL compliance is preferred, it is not mandatory. Candidates should demonstrate exceptional judgment, outstanding organizational skills, robust research and legal analysis capabilities, and the ability to provide sound legal counsel to senior attorneys.
