**Job **Summary**

This position reviews requests for access to City information made under the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) and the Personal Health Information Protection Act (PHIPA). Formulating decisions on requests for access under custody or control of the City, and ensuring compliance with the Acts, Regulations and Orders and Findings of the Information and Privacy Commissioner. Identifying records held by the following divisions and preparing them for review: Employment & Social Services, Shelter Support & Housing Administration, Children's Services, Housing Secretariat, Seniors Services & Long-Term Care, and Social Development Finance & Administration. In consultation with the TESS Manager Program Support, and the Manager, Access Unit, City Clerk's Office, you will review requests and recommend decisions on access to them.

Major Responsibilities:

- Develops and implements detailed plans and recommends policies regarding program specific requirements.
- Manages assigned projects, ensuring effective teamwork and communication, high standards of work quality and organizational performance and continuous learning.
- Conducts research into assigned area ensuring that such research takes into account developments within the field, corporate policies and practices, legislation and initiatives by other levels of government.
- Develops corporate policy and recommends standards and practices for the dissemination of corporately held information that are aligned with the legislative standards set out in MFIPPA and PHIPA. Assesses the impact of access decisions and compliance issues on organizational business practices and procedures.
- Communicates with the media, legal and governmental representatives and members of the public in clarifying issues that arise, negotiating with requesters and divisional staff, explaining finer points of the legislation, mediating and advising on the right of appeal to the IPC.
- Formulates decisions on requests for information based on detailed analysis of records and prepares formal decision letters under the City Clerk's signature, including where appropriate, information on specific exemptions, fees and appeal rights.
- Proposes policies, recommendations and standards for compliance with MFIPPA and PHIPA according to legal requirements, corporate governance, national standards and operating requirements of the City
- Conducts specialized mediation with the Information and Privacy Commissioner in the event of an appeal to the Commissioner, and participates in oral inquiries before this tribunal.
- Drafts affidavits and representations for submission to the IPC in defence of the City's decision at the adjudication stage of an appeal, by conducting in-depth research and analysis of the records and issues to be resolved, keeping in mind Orders of the IPC, mitigating factors and legal precedents.
- Provides advice and recommendations on privacy compliance through consultations with City staff members at all levels regarding special information access and disclosure challenges as well as issues surrounding emerging technologies.
- Responds to formal and informal privacy complaints that are often sensitive and/or political, by conducting research and investigation into the complaint, and by seeking a resolution through mediation. Advises complainant of further options to pursue complaints and liaises with the IPC during the complaint process. Prepares letter to the IPC detailing the City's position regarding complaint and/or resolution.
- Ensures that electronic forms and other material posted by Agencies, Boards, Commissions and other external partners on the City's Website are in compliance with privacy requirements under the Act.
- Prepares specialized training modules on the MFIPPA and PHIPA legislations for Councillors and City Staff, and conducts training sessions utilizing traditional and innovative training methods.

**Key **Qualifications**:

- Experience in reviewing records for exemptions under MFIPPA.
- Extensive knowledge of provincial legislation and the orders of the Information & Privacy Commission governing access and privacy issues.
- Extensive knowledge and understanding of Social Services provided in Ontario and their associated records would be an asset.
- Well-developed communication skills, (both written and oral) and interpersonal skills to build good internal/external working relationships.
