The Discipline Tribunal (the Tribunal) is an independent adjudicative tribunal established under the Health Professions and Occupations Act (HPOA), led by the Director of Discipline. The Tribunal is housed within the Office of the Superintendent of Health Profession and Occupation Oversight (OSHPO) which will oversee the province’s health professional regulatory colleges who regulate over 130,000 health professionals collectively. The Tribunal is an administrative tribunal specialized in conducting hearing proceedings to determine disciplinary action against regulated health professionals who contravene the Act or their obligations under it. The Tribunal operates at arm’s length from the government in its decision-making and is independent.

The Tribunal has exclusive jurisdiction to conduct discipline hearings and to issue disciplinary orders following a hearing. There can be a high degree of public scrutiny of decisions. The Director of Discipline oversees the tribunal, remaining independent from disciplinary hearing outcomes. They do not sit on or chair the panel of disciplinary hearings. The Director selects members to sit on the three-person panel during a disciplinary hearing, overseeing the tribunal’s functions, timeliness to resolve matters, and processes. They are responsible for conducting reviews of disciplinary orders when challenged, providing un-biased and objective insight into determinations. The Director is responsible for setting and maintaining practice directives of the Tribunal to facilitate the just and timely conduct of hearings. In addition, they lead the development, maintenance, and publishing of policies to appoint and retain discipline panel members.
