Reporting to the Chief Insolvency Officer, the Licensed Insolvency Trustee ensures compliance with insolvency legislation, CAIRP professional standards, and Bromwich+Smith values and best practices. The primary objective of the Trustee is to provide a high level of service, expertise and professional advice to stakeholders, and to ensure the administration of files are conducted in a professional and timely manner.
Key Accountabilities
Estate Administration:
Ensure adherence to all Estate Administration policies and procedures.
Provide technical guidance on all aspects of Estate Administration to relevant stakeholders.
Oversee the end-to-end insolvency administration process.
Collaborate and ensure legal compliance and 'best practices' are applied to current and new Estate Administration processes.
Collaborate with the Manager of Insolvency Administration to ensure best practices are being adhered to for both bankruptcy and proposal administrations and to ensure the client journey represents B+S's values.
Attend Trustee Council meetings.
Bankruptcy / Proposal / Consumer Proposal:
Ensure that appropriate steps are taken to monitor and correct shortfalls in Debtor / Bankrupt compliance.
Ensure Bankruptcy / Proposal is administered in a legally compliant and the most effective and efficient manner.
Monitor, mentor, and collaborate with the Bankruptcy Estate Manager, Estate Administrators, and Proposal Specialist to ensure timely estate realization (payments) and statutory compliance.
Review and sign all cheques drawn on Estate Accounts.
Review and sign disbursements in a timely manner.
Ensure Proposal Administrations lead to full performance status".
Ensure Bankruptcy Administrations lead to timely and aggressive discharges while in compliance with the Act".
Attend Court proceedings where necessary.
Review and sign the forms and documentation listed in Directive 4R in the BIA.
Compliance
Implement and monitor an internal control system to maintain and sustain compliance with the Regulator.
Ensure alignment to administration processes, documentation, and decision-making.
Ensure compliance to ethical and professional requirements as per Office of the Superintendent Bankruptcy Canada (OSB) and the Canadian Association of Insolvency and Restructuring Professionals (CAIRP).
Ensure all legal checkpoints (due diligence) are adhered to in compliance with the Bankruptcy and Insolvency Act (BIA).
People Relationships
Maintain and improve existing business relationships.
Discuss and resolve legalities and related issues at Trustee Council Meetings to minimize risk to B+S team.
Model and promote B+S's organizational culture and values.
Champion and foster a climate of diversity and inclusion.
Provide informal leadership through mentoring and development support to mentees (Trustee program and/or Estate Administration course).
Provide situational problem solving and guidance to team members via informal leadership.
Education, Knowledge & Skills:
Certified Insolvency and Restructuring Professional (CIRP) designation
Licensed Insolvency Trustee in good standing
Degree or diploma in a relevant field and preference will be given to candidates with an accredited Accounting Designation
Registered Bankruptcy and Insolvency Act (BIA) Counsellor
Commissioner for Oaths
At least 5 years' experience as a Licensed Insolvency Trustee specializing in Consumer Insolvency
Experience in the legal or financial industries (in particular consulting with potential insolvents)
Advanced proficiency with Microsoft Word and Excel and experience with insolvency software
Working knowledge of Internet applications along with aptitude for learning new computer programs
Role Specific Complexity:
Task complexity ranges from one day for a simple task to three years for the most complex task to perform; and on Debtor's discharge from Bankruptcy (maximum 5 years).
Ensure multi directional communication with external stakeholders, specific to legal counsel and the regulator.
Manage and coordinate several complex and interacting issues simultaneously in order to achieve overall objective.
Involve coordinating and overseeing the inputs of various functional business units i.e. Insolvency Administration Specialists and multiple stakeholders i.e. Creditors, Debtors, etc.
Show the ability to balance tactical day to day responsibilities while ensuring focus on the long-term success of the business.
Analyze and synthesize critical information points to ensure legal compliance and timely, accurate controls and reports.
Maintain the pace of and monitors several interacting tasks and objectives.
Judgement relates to the degree of accuracy achieved and on how the rules may be applied in a given situation; evaluating, planning and implementation to optimize resources.
Use specialized knowledge of operational work and incorporates theory and experience.
Evaluate systems, processes and play an integral role in implementing 'best practices' to make the best use of all available resources.
Local and domestic (Canada) travel of approximately 5%.
Ability to operate, respond under pressure and to work in multiple time zones as required.
This role also requires good time management, organizing and planning skills. A person in this role interacts with multiple stakeholders with varying priorities; manages tight deadlines for document submissions, appointments; drives alignment between several objectives while coordinating and managing his or her own schedule.
Another success criteria for the person in this role, is an empathic attitude, sufficient interest, and passion to sustain high levels of involvement over time, in a committed and goal directed manner.
This role requires the person to do presentations to Court, various Creditors and fellow Trustees on Debtor information. Optimally, a person needs to do this in a calm, cooperative, assertive and issue-focused way; be able to explore alternative options, needs, concerns and disagreements to reach an optimal outcome or win-win situation. At times, the person may be involved in sensitive, difficult conversations with internal / external stakeholders.
Attend company sponsored events approximately 5%.
Willingness to sit as a board member on Provincial Insolvency Committees.
Maintain professional designation requirements through continuous education.
This position is responsible for following all applicable company, governmental, legal, safety, quality and regulatory policies and procedures at all times for the Trustee portfolio.
Informal leadership is required for success in this role. This depends on the person's ability to work effectively with others to achieve clear objectives, while respecting the needs and contributions of others, providing motivating guidance and constructive feedback, yet allowing others to take ownership.
