About the Role

We are seeking a highly experienced Senior Manager, Claims Management to join our Capital Projects Commercial Management Office. This is a key leadership role that will provide strategic direction and expertise in the management of the claims process to support the Capital Projects Group's delivery of capital and infrastructure projects.

Key Responsibilities
  • Manage the claims management team responsible for providing commercial and contractual advice to project delivery teams to ensure that claims are settled efficiently and in a timely manner.
  • Lead the evaluations and negotiations of major and complex claims, including directing and managing cross-functional teams in the process.
  • Proactively champion claim avoidance and mitigation efforts, coordinating with project teams, including both commercial and technical teams.
  • Suggest and assist in the implementation of improvements to contractual terms for claim avoidance and claim mitigation.
  • Lead the claims management process across a wide range of Metrolinx transit and infrastructure projects, including management and maintenance of claims registers, documentation/records, and timely reporting of overall claims status.
  • Develop and implement claims management governance frameworks, processes, and tools to support effective and efficient claims management, including that for claim avoidance and mitigation.
  • Contribute to the development and manage the administration of claims management policies, procedures, and practices.
  • Ensure corporate objectives (KPIs) and targets are adhered to in the claims management process.
  • Manage the development and implementation of a claims management training program for project teams, consultants, and Metrolinx executives.
  • Coordinate and manage alternate dispute resolution processes, such as mediation, arbitration, and litigation, between project teams and legal teams, including expert witnesses.
Requirements
  • Demonstrated years of experience in major project claims management with successful resolution in favor of the client.
  • Progressive experience in the management and administration of major construction/infrastructure contracts in a public sector environment.
  • Commercial Manager or Contracts Manager experience in the construction industry, working at a senior level.
  • Completion of a degree in construction management, project management, engineering, quantity surveying, or a related discipline, or a combination of education, training, and experience deemed equivalent.
  • Active membership in PEO, AACE, PMI, CIQS, RICS, CIArb, or similar professional association is an asset.
  • Sound knowledge of commercial management and contract management policies, principles, procedures, and industry best practices to manage the claims management process.
  • Experience in preparation and/or evaluation of various claims, including delay, disruption, loss of production, acceleration, and scope changes, including schedule analysis.
  • Ability to read engineering drawings, review construction schedules, validate cost and quantum calculations for direct and indirect costs.
  • Knowledge and understanding of construction methodologies and contractor's tender pricing, involving pricing of temporary and permanent works, risks, and contingency allocations, overheads, and escalation pricing.
  • Knowledge and understanding of alternative dispute resolution techniques and excellent negotiation skills to arrive at fair settlements on claims.
  • Experience in managing and coordinating the claim management process with project teams, consultants, external experts, and legal counsel.
  • Knowledge of contract administration and project delivery using AFP, P3, or design/build methodology, associated contracting terms and risk transfers, and an understanding of relevant contract law/regulations.
  • Good understanding and knowledge of the practical application of contract administration and document management software, CM14, Aconex, ProjectWise, and SharePoint.
  • Familiarity with scheduling software like Primavera P6, Microsoft Projects, and/or Tilos.
  • Experience in managing and mentoring contract teams involving claim analysts, forensic schedulers, and contract managers/administrators.
