Position Summary

We are seeking a skilled In-House Legal Counsel to enhance our dynamic team.

Key Responsibilities:

  • Provide legal representation for the claims division and its policyholders in Property and Casualty litigation matters.
  • Manage insurance defense cases from inception to resolution.
  • Prepare and present initial assessments with recommendations on liability, damage evaluation, and case management strategies.
  • Counsel clients on the necessity for further investigations and propose innovative strategies for expediting case resolutions.
  • Utilize civil procedure regulations to enforce document production and early discovery timelines. Draft legal opinions, pleadings, affidavits, and other essential documents for motions, mediation briefs, and pre-trial memoranda.
  • Prepare and execute applications/motions, discoveries, mediations, arbitrations, pre-trial conferences, and trials.
  • Conduct research and provide legal advice on issues affecting claims. Update clients following discovery sessions or upon receiving information that may influence damage assessments or prompt case resolutions.
  • Advise clients on emerging legal trends.
  • Negotiate settlements with opposing counsel and provide both verbal and written insights on insurance policy interpretations and coverage matters.
  • Organize and deliver educational seminars for the claims division. Maintain effective communication with the claims team and individual adjusters.
  • Collaborate with the Litigation Department to implement initiatives aimed at delivering cost-effective and high-quality legal services.
  • Handle a variety of insurance litigation cases from start to finish.
  • Draft legal documents to support applications, mediations, judicial settlement conferences, and trials.
  • Independently manage applications, discoveries, mediations, arbitrations, pre-trial conferences, and trials.
  • Develop and present legal training sessions for the claims division and assist colleagues from other departments with inquiries.
  • Ensure productive and effective communication with the claims division and adjusters.

Qualifications:

  • Active member of the Law Society.
  • A minimum of 2 years of experience in insurance litigation; open to various levels of expertise.
  • Proficient in legal research and writing, including the creation of legal opinions.
  • Experience in drafting pleadings, conducting discoveries, mediations, application documents, and pre-hearing memoranda.
  • Knowledge of alternative dispute resolution (ADR) processes.
  • Trial experience, particularly independent trial experience, is a significant advantage.
  • Strong verbal and written communication skills, coupled with research and negotiation experience.
  • Exceptional organizational skills, capable of managing multiple case files concurrently.
  • Strong interpersonal skills with the ability to cultivate effective client relationships.
  • Bilingual proficiency (English/French) is required, with fluency in both spoken and written forms.
  • No Canadian work experience is necessary; however, eligibility to work in Canada is required.
