Position Summary
We are seeking a skilled In-House Legal Counsel to enhance our expanding legal team.
Key Responsibilities:
- Provide comprehensive legal representation to the claims division and its clients regarding Property and Casualty litigation matters.
- Manage insurance defense cases from inception to resolution.
- Prepare and present initial assessments that include recommendations on liability, damages evaluation, and strategic file management.
- Counsel clients on the necessity for further investigation and propose innovative strategies aimed at expediting case resolution.
- Utilize civil procedure regulations to enforce document production and early discovery timelines. Draft legal opinions, pleadings, affidavits, and other essential documents to support motions, mediation briefs, and pre-trial submissions.
- Conduct and oversee applications/motions, discoveries, mediations, arbitrations, pre-trial meetings, and trials.
- Research and advise clients on legal issues affecting claims, providing updates post-discovery or upon receipt of significant information.
- Keep clients informed about evolving legal trends.
- Negotiate settlements with opposing counsel and provide comprehensive opinions on insurance policy interpretations and coverage matters.
- Develop and deliver educational sessions for the claims department, ensuring effective communication with claims personnel and adjusters.
- Collaborate with the Litigation Department to implement cost-effective and high-quality legal service programs.
- Handle a variety of insurance litigation cases from start to finish.
- Draft legal documents to support applications, mediations, judicial settlement discussions, and trials.
- Independently manage applications, discoveries, mediations, arbitrations, pre-trial meetings, and trials.
- Provide legal training sessions for the claims department and assist colleagues from other departments with inquiries.
- Maintain effective communication with the claims department and adjusters.
Qualifications:
- Active member of the Law Society.
- A minimum of 2 years of experience in insurance litigation; candidates with varying levels of experience are encouraged to apply.
- Proficient in legal research and writing, including the creation of legal opinions.
- Experience in drafting pleadings, conducting discoveries, mediations, and preparing pre-hearing documents.
- Familiarity with alternative dispute resolution (ADR) processes.
- Trial experience, particularly independent trial experience, is a significant advantage.
- Strong verbal and written communication skills, coupled with negotiation and research expertise.
- Exceptional organizational abilities, capable of managing multiple case files concurrently.
- Strong interpersonal skills with the capacity to cultivate effective client relationships.
- Bilingual proficiency (English/French) is required, with fluency in both spoken and written forms.
- No prior Canadian work experience is necessary, but candidates must be eligible to work in Canada.
