We are currently looking for an** Enforcement and Legal Counsel** to join our team.

**Position Summary**:
As an Enforcement and Legal Counsel, you will support TSSA’s regulatory and enforcement actions. Reporting to Assistant General Counsel, you will counsel TSSA on external and internal regulatory matters, review cases, draft information, review search warrants, draft Notice of Proposals (NOPs), prosecute cases before the Ontario Court of Justice and represent the TSSA before the Director on NOPs

You will also be responsible for external and internal appeals. As our Enforcement and Legal Counsel, you will provide legal advice to inspectors and investigators. You will draft statutory instruments and consult on various policy matters.

To be successful, you must possess an advanced knowledge of regulatory law, rules of evidence, court processes, strict liability processes and procedures. You will need excellent Communication skills: strong verbal and written (technical paper development and presentations, public relations/public speaking) skills and ability to understand and communicate complex technical concepts.

**Responsibilities**:

- Support prosecution of offences under the Technical Standards & Safety Act and its associated regulations and the Provincial Offences Act, from inception to conclusion, as assigned.
- Support TSSA’s business and regulatory initiatives by conducting enforcement and administrative litigation; assisting management in resolving regulatory and enforcement issues (administrative hearings and appeals).
- Provide timely information to customers (e.g., providing legal advice and direction to management concerning statutory and regulations interpretation, corporate, commercial, regulatory and policy issues;). demonstrate TSSA’s corporate values; and adhere to and promoting ethical business practices.
- Support the development of policies and procedures on issues relating to prosecutions under the Act.
- Share expertise and best-practices (e.g., legal counsel, interpretation and recommendations to staff); participate in the training and development of others; and provide back-up for colleagues.
- Provide legal advice and delivers training to inspection and engineering staff on legal processes and requirements.

**Job Qualifications**:

- Must have university degree and Law Society of Upper Canada Membership
- Called to the Bar in Ontario with 5 or more years’ relevant experience and at least 3 years' prosecution experience.
- Prior experience prosecuting provincial offences under POA preferred
- Legal analysis and research skills. Litigation related analytical problem solving ranges from intermediate to complex.
- Communication: strong verbal and written (technical paper development and presentations, public relations/public speaking) skills. Ability to understand and communicate complex technical concepts
- Advanced knowledge of regulatory law, rules of evidence, court processes, strict liability processes and procedures
- Advanced knowledge of administrative law, and constitutional / charter law
- Knowledge of investigative procedures / requirements, evidence law, criminal and provincial offences procedures
- Business acumen: concepts, processes, policy development
- Advanced level proficiency in MS Office Suite
