Bring your excellent analytical and communication skills to our team as a Legal Advisor within our Professional Liability Program (PLP) department.

The Professional Liability Program (PLP) administers RCDSO’s malpractice insurance program for all current and former RCDSO dentists. This includes claims management, insurance management a nd risk management.

The Legal Advisor provides legal support to the Manager, Professional Liability Program , assists Ontario dentists with medico legal issues by managing and/or overseeing the management of actual or potential dental malpractice litigation, and provides risk management information and advice .

You are a dynamic self-starter, creative, efficient and can effectively analyze issues, develop strategies and resolve legal disputes.

This is anticipated to be a 12-month contract with a start date of July 2024. The role is classified as fully remote; however, depending on business needs , you may occasionally attend our Toronto office . At this time , we are only considering candida tes loc ated in Ontario or who are willing to relo cate .

What can I expect to do in this role?

Reporting to the Manager, PLP , you will be :

  • Receiving and handling repo rts from dentists about medico legal issues , and managing the dentist-patient relationship
  • Interviewing dentists and gathering information and documents to triage reported problems
  • Advising dentists on options and strategies, including implications, outcomes and management of risk
  • Providing dentists with information, legal advice and documents to assist them in resolving disputes
  • Investigating dental malpractice allegations, including reviewing and analyzing patient records, legal pleadings and expert reports, as well as assessment of the potential validity of such claims Development of file strategy, including assessing liability and damages
  • Communicating with patients and/or their legal representatives regarding the merits of claims and negotiating settlements, if applicable
  • Supervising and instructing external counsel retained to defend dentists involved in civil litigation proceedings
  • Retaining and instructing experts for medical legal claims, reviewing and analyzing medical-legal reports
  • Managing large caseloads, including complex and protracted proceedings
  • Attending mediations, pre-trial and settlement conferences, as required
  • Liaising and reporting, both orally and in writing, to PLP Committee and re-insurer , and providing them with recommendations and reports regarding case value and strategy
  • Financial and fiscal review and management of file reserves and legal expenses
  • Providing advice to dentists on how to avoid medical and legal problems through one-on-one discussions, presentations, and written materials
  • Preparing and delivering group presentations to the dental profession
  • Provide direction to the senior administrative assistant, law clerk, and when necessary, to the records clerk
  • Conducting legal research and analysis, and assisting PLP staff and dentists with legal issues
  • Remaining current with legal issues, case law developments and implications of same on topics including medical malpractice, privacy, consent, capacity and insurance, and informing the PLP team regarding same
  • Updating PLP legal information packets for external defence counsel and the PLP knowledge library

What skills and background do I need?

The Legal Advisor requires :

  • J.D. or equivalent; member of the Law Society of Upper Canada
  • Personal injury experience required ; two-to-three years of medical malpractice experience preferred
  • Excellent written and oral communication skills, sound judgment, excellent organizational and analytical skills, initiative , and the ability to work with minimal supervision
  • Ability to organize, prioritize assignments , and produce a high volume of work quickly and accurately
  • Ability to work under pressure and meet deadlines
  • Ability to work within a team environment
  • Ability to think critically and try different approaches to solve a problem
  • Demonstrated ability to review medical records/information, identify issues and ask key questions
  • Knowledge of medical/dental terminology is an asset
  • RCDSO is building its bilingual (French/English) capacity and excellent French language proficiency is an asset

Compensation and Total Rewards

  • Base annual hiring salary ideally from $1 27,867.7 8 to $ 137,50 0 , commensur ate with experience
