The Litigation and subrogation advisor oversees a portfolio of subrogation claim files and analyzes cases that may be subject to recovery. This role determines, plans, and carries out the actions that must be taken on files under their supervision, all while respecting the parties involved.

Summary of Role & Responsibilities:

Direct handling of files involving subrogation and ensure regular, autonomous, and timely follow-up Carry out the analysis of complex and bigger scale files transferred to the direction of recovery Analyze claims data to identify potential recovery situations Carry out the collection of the amount paid to the third party and responsible companies Act as a resource person and offer technical support to our lawyers in the analysis, strategy, and resolution of subrogation Represent Unica Insurance in legal proceedings related to the exercise of its functions (trial, CRA, mediation, interrogations, arbitrations, and others) and collaborate with lawyers in the preparation of hearings Participate in pre-arbitration discussions with other signatory compagnies and negotiate a settlement, in accordance with the CICMA inter-company arbitration agreement Prepare and submit the allegations to the CICMA Arbitration panel. Negotiate the settlement of files within their authority taking into consideration all potential risks and draft the relevant transaction and release documents Give external mandates to the concerned professionals or, according to the case, carry out the procedure to the investigation complement Exercise an advisory role regarding subrogation and recovery measures. Provide coaching if needed Exercise a professional role support with managers, experts, claims adjusters, technicians, technical experts in the execution of their tasks related to subrogation Interact autonomously with internal and external stakeholders on all matters related to the exercise of subrogation, collections and litigious files Carry out insurance recovery monitoring activities to anticipate trends Determine the cost-effectiveness (cost/benefit approach) of subrogation actions, by cross-referencing different data to assess the overall exposure of Unica Insurance Participate in the development of recommendations to improve collection controls, with a view to sound cost management Participate to the relieving crew in case of a catastrophe Assume, upon request, any related responsibility

Necessary Knowledge, Skills and Attributes:

Excellent knowledge of the laws and regulations applicable to damage insurance and the exercise of civil remedies Previous paralegal experience is an asset Demonstrate a sustained ability for interpersonal relationships, oral and written communication, teamwork, negotiation and capacity to take good decisions Demonstrate rigor and thoroughness Strong analytical skills Ability to evolve autonomously in a highly complex environment Ability to travel outside of the workplace, if needed

Education and Experience:

University degree or equivalent Enrollment in or completion of the CIP (FCIP) Designation At least five years of commercial and personal lines claims Bilingual fluency, oral and written in French
