Overview

Are you passionate about administrative law? Do you want to join a motivated team of lawyers who value hard work while prioritizing a healthy lifestyle with a strong focus on work-life balance? WorkSafeBC's Legal Services department is seeking a recently called lawyer for the Hearings Lawyer position within our Prohibited Action Complaints (PAC) department.

In this role, you'll manage submissions and evidence for the hearing of prohibited action complaints filed by workers under the Workers Compensation Act ("WCA") related to workplace reprisals for exercising health and safety rights under the WCA.

This opportunity is temporary for 12 months.

How you'll make a difference: You'll ensure WorkSafeBC is serving stakeholders across B.C. effectively

Where you'll work

At WorkSafeBC, we offer a hybrid work model that combines working remotely, and in our offices based on the operational needs of the position.

What you'll do

  • Manage the submission and evidence steps in the PAC hearing process by obtaining submissions and evidence from parties, responding to inquiries from parties regarding the hearing process and enforcing/extending deadlines
  • Ensure files are ready for a written hearing by a Legal Adjudicative Officer by reviewing submissions and evidence in order to ensure the record of evidence is complete as required at law
  • Determine whether a worker has met a prima facie case of prohibited action and prepare written decisions where the prima facie case is not established
  • Complete research and analysis of law, policy, and jurisprudence to ensure that WorkSafeBC's PAC process meets the requirements of administrative law applicable to hearings
  • Consistently model the appropriate level of organizational behaviours expected of all WorkSafeBC employees: responsive, respectful, fair, collaborative, accountable, and forward thinking.

Is this a good fit for you?

We're looking for people who can:

  • Communicate legal concepts and decisions in a clear and concise manner to individuals and groups with varying levels of understanding
  • Employ sound judgment in the application of law and policy to weigh evidence, make decisions, and resolve issues
  • Demonstrate understanding of administrative law and rules of evidence
  • Prioritize a large volume of work in tight deadlines with ability to respond to external pressures
  • Interact with management, team members, and stakeholders in a confident, professional and objective manner

Your background and experience

  • Must have a Bachelor's of Law Degree (LL.B. or J.D.)
  • A member in good standing with the Law Society of British Columbia
  • 3-6 months of legal experience

We'll consider equivalent combinations of education and experience.

Important to know

Before we can finalize any offer of employment, you must:

  • Confirm you're legally entitled to work in Canada
