**Overview**
As we move through a period of exciting transformation and organizational change, Professional Engineers Ontario (PEO) has an immediate opening for an **Investigator**.
Under the authority of the _Professional Engineers Act_, PEO licenses and governs over 91,500 licence and certificate holders and regulates the practice of professional engineering in Ontario. PEO’s mission is to regulate and advance the practice of engineering to protect the public interest. With a talented, multidisciplinary staff of over 100, PEO’s vision is to be a trusted leader in professional self-regulation.
**Position Summary**
- The position incumbent reports to the Manager, Investigations and is responsible for investigating assigned matters involving complaints filed against Licensees, Temporary Licensees, Limited Licensees, Provisional Licensees and Certificate of Authorization holders on behalf of Complaints Committee.
**Responsibilities**
- Review complaint form and supporting material submitted by complainant and assess for professional misconduct and/or incompetence issues under the Professional Engineers Act.
- Interview complainants, witnesses, and respondents in the gathering of information to impartially achieve an understanding of the complaint circumstances.
- Identify, collect, and securely preserve evidence (records, drawing, reports, correspondence, and other documentary and/or electronic evidence) that are relevant to the complaint to adequately support investigation results and meet admissibility requirements of any subsequent proceedings or tribunals.
- Engage independent experts as required to provide opinions regarding the work of the respondents.
- Prepare regulatory correspondence as required throughout the course of investigation. Communicate on an established regular basis with complainants and respondents during the course of investigation.
- Prepare complaint summary and investigative summary documents for review by the Complaints Committee.
- Support administrative staff to prepare case files for review by the Complaints Committee.
- Attend Complaints Committee meetings and be prepared to provide clarification regarding file details and investigation; draft letters of advice, arrange for interviews of respondents by the Complaints Committee, or coordinate voluntary undertakings, as directed by the Complaints Committee.
- Liaise with Legal department and prosecuting legal counsel to hand over files referred to the Discipline Committee.
- Support prosecuting legal counsel as required in preparation for a discipline hearing; participate in pre-hearing conferences and other resolution negotiations as required.
- Attend discipline hearings as required.
**Specialized Skills and Knowledge**
**Knowledge/Skill in**:
- General knowledge of professional engineering disciplines and practices.
- Criminology, judicial, quasi judicial processes to conduct investigations and testify in a court of law or tribunal.
- Strong written and oral communication to conduct interviews, issue regulatory communications, provide clarification on investigative findings at Complaints Committee.
**Interpersonal/Communication**:
- Superior written and communication skills to draft investigation summaries and provide clarification on complex investigative findings to Complaints Committee regarding investigations.
- Interpersonal skills and tact/diplomacy when dealing with various PEO committees and council members.
- Use of tact, diplomacy and sensitivity to interview / collect information relevant to investigations from potentially hostile, deceptive or fearful/concerned individuals.
- Work effectively in a team environment and can collaborate with team members.
**Decision Making/Judgement**:
- Make findings regarding investigations and identifying risks during investigations that Complaints Committee can consider for corrective and/or disciplinary action.
- Prioritizing investigations based on risk and complexity.
- Determine investigative strategies that will yield timely, responsible, informed, useful information, in weighing evidence, determining the facts and circumstances of situations to support decision making for Complaints Committee.
- Develop investigation plans.
- Provide technical guidance, advice and coaching to team members and resolve problems during the course of an investigation.
- Make decisions that are guided by legislation and regulatory guidelines, investigation standards and best practices, past practices and precedents, professional codes of conduct and quality standards.
**Leadership**:
- Prioritize investigations and manage conflicting demands and deadlines.
- Project management expertise to ensure that investigations are completed in a timely manner.
