Job SummaryThe UBC Investigations Office (“IO”) manages formal complaint processes under UBC’s Sexual Misconduct Policy, Discrimination Policy, Retaliation Policy, Respectful Environment Statement, and the Public Interest Disclosure Act Policy (collectively, the “Policies”). The Investigator is primarily responsible for investigating complaints under the Respectful Environment Statement, but may be required to investigate complaints under the other Policies from time to time. In all investigations, the Investigator is expected to proceed in accordance with relevant Policies and laws, and uphold principles of procedural fairness and a trauma-informed approach.Organizational StatusThe Investigator reports to the Associate Director, Investigations.Works collaboratively with relevant stakeholders including Human Resources, the Equity and Inclusion Office, Student Conduct and Safety, the Sexual Violence Prevention and Response Office, Respondent Resource Specialist, and the Office of University Counsel. Liaises professionally with external entities including government, law enforcement, legal counsel, and external investigators. Operates in a complex unionized environment, with various staff and faculty unions and associations.Work Performed• Conducts investigations as assigned by the Associate Director of Investigations, including:Identifying key issues for determinationEnsuring a fair, accessible processCollecting evidence, including interviewing parties and relevant witnesses using a trauma-informed approachAssessing credibility where required to make sound findings of factApplying relevant Policies and lawsPreparing clear, concise written investigation reports• Liaises and corresponds with all involved parties, including complainants, respondents, union and association representatives, legal counsel, and administrative heads of unit regarding investigations.• Exercises a high degree of diplomacy and tact in responding to investigation-related inquiries from internal and external parties• Acts as a peer reviewer as part of the IO’s internal investigation report review process• Collaborates with IO staff in communications, education, analysis and administrative support in the development and review of IO internal processes and procedures• Participates professionally, constructively and collaboratively in campus-wide forums, including those related to Policy review and implementation • During investigations and in consultation with the parties, may consider alternative paths for more restorative outcomes, including using alternative resolution processes per the PoliciesConsequence of Error/JudgementThe Investigator is a position of significant responsibility and trust. The matters that are investigated under the Respectful Environment Statement and other Policies are often serious and complex, and can result in significant disciplinary consequences for community members. Sound judgment and sensitivity are imperative to engender confidence in the credibility and integrity of UBC’s investigation processes. If investigations are not conducted properly, in accordance with relevant Policies and laws, and employing a trauma-informed approach, there is potential for significant negative impact on the University and its community members. This includes increased individual trauma, and legal, reputational, and financial harm to the University.Supervision ReceivedWorks independently under the direction of the Associate Director, Investigations Office.Supervision GivenNoneMinimum QualificationsUndergraduate degree in a relevant discipline. Minimum of seven years of related experience, or the equivalent combination of education and experience.• Willingness to respect diverse perspectives, including perspectives in conflict with one’s own• Demonstrates a commitment to enhancing one’s own awareness, knowledge, and skills related to equity, diversity and inclusionPreferred Qualifications• Undergraduate degree in law, social work or social sciences• Training and experience in workplace, institutional and/or regulatory investigations• Demonstrated knowledge and application of trauma-informed approaches• Demonstrated knowledge and application of equity, diversity and inclusion (EDI) competencies, including understanding and respect for the ways in which identity shapes an individual’s experience, and applying an intersectional lens• Recent and significant experience conducting investigations, including interviewing, report writing, assessing credibility and applying policy and/or law• Familiarity with administrative law, labour and employment law, and human rights law• Recent and significant experience in applying trauma-informed investigation approaches• Demonstrated ability to operate in complex environments• Strong interpersonal and diplomacy skills• High emotional intelligence and maturity• Effective organizational skills with ability to multi-task and prioritize to meet deadlines• Effective evaluating, problem solving, analyzing and decision-making skills• Exceptional attention to detail• Proven intercultural competencies and an ability to effectively communicate and interact with members from diverse communities• Ability to work well as part of a small, diverse and specialized unit• Commitment to continuous self and systems improvement• Ability to manage priorities and shift according to the needs of the unit• Proficiency in Microsoft Office with strong computer skills
