Job Description

This course focuses on Charter rights and remedies in the criminal law context, defending an accused in a criminal prosecution. The topics covered include constitutional remedies available in a criminal case, from challenging legislation to challenging state actor conduct. Remedies under sections 24(1) and 24(2) of the Charter and section 52(1) of the Constitution Act will be explored, as well as Charter rights and protections, including abuse of process, the right to counsel, and the law of search and seizure. The course will consider societal rationales supporting Charter rights and remedies and the balancing of competing interests in deciding whether Charter rights have been infringed and the appropriate remedy.

Responsibilities
  • Teach this course either online, in-person, or hybrid mode at the discretion of the Faculty and in accordance with public health guidelines.
  • Have significant practical experience related to Canadian criminal law and experience with Charter remedies.
  • Be a leader in the legal profession with an LL.B., J.D., or equivalent and membership in the Law Society of Ontario (or equivalent) in good standing.
Requirements

The Common Law Section is seeking candidates who meet the requirements and have the necessary experience. The successful candidate will have a strong background in Canadian criminal law and Charter remedies. Prior teaching experience will be considered an asset.
