As a key member of the Pharmascience team, the Intellectual Property Specialist will play a pivotal role in enhancing patent protection and clearance of the company's licensed and/or internally developed products. This position requires a global perspective on IP matters and policy to support country, regional, and international operations. The successful candidate will advise on data protection and other forms of regulatory exclusivity, provide due diligence and transactional support, and contribute to court and administrative litigation efforts.

Key Responsibilities:

The Intellectual Property Specialist will be responsible for:

  • Designing and implementing effective Intellectual Property Strategies from product selection to launch, considering business objectives, patent landscape, regulatory exclusivities, and local regulatory requirements.
  • Participating in pipeline product selection by assessing generic market entry dates, regulatory submission dates, and launch dates in targeted countries, in view of business objectives, patent landscape, regulatory exclusivities, local, and regulatory requirements.
  • Advising the R&D team on formulation development, taking into account the patent landscape and established IP strategy to mitigate litigation risk.
  • Timely and effectively communicating key changes on the IP landscape affecting project timelines and litigation risks.
  • Performing patentability, validity, and freedom-to-operate searches, including web, patent databases, and literature searches.
  • Conducting intellectual property due diligences to support business development transactions.
  • Supporting internal litigation on Intellectual Property related proceedings, challenges, disputes, and litigation.
  • Staying current with relevant Intellectual Property legislative developments in core markets.

Required Skills and Knowledge:

The successful candidate will possess:

  • An excellent scientific background in organic chemistry, biochemistry, and/or formulation development.
  • Knowledge in areas such as formulation development, stereochemistry, solid state structure of active pharmaceutical ingredients, particle size distribution, X-ray powder diffraction analysis, Differential scanning calorimetry, and other analytical methods.
  • Basic knowledge in regulatory exclusivities, such as data protection and market exclusivity for new pharmaceutical products in CA, US, and Europe, as well as other patent-related exclusivities.
  • Bilingualism in French and English, given the interactions with international external partners.
  • Ability to navigate patent databases, including CIPO, USPTO, EPO-Patent Register, Espacenet, Orbit/Questel/Patsnap, and equivalent databases.
  • Knowledge and understanding of relevant Intellectual Property legal principles.
  • Excellent communication and problem-solving skills, with the ability to make complex ideas clear and understandable.
  • Ability to work as part of a cross-functional team, with a proven track record of driving results and maintaining high ethical and personal standards.
  • Proficiency in Microsoft Office, especially Access, Word, PowerPoint, and Excel.
