Course Overview

This course examines the legal, constitutional, and practical considerations in investigating, prosecuting, and defending hate crimes under section 319(1) and (2) of the Criminal Code, as well as regular Criminal Code offenses such as criminal harassment and mischief.

Course Objectives

  • Explore the constitutional issues surrounding hate crimes
  • Examine the legal considerations in investigating and prosecuting hate crimes
  • Discuss the practical considerations in defending hate crimes

Course Format

This course will include lectures, focused discussions, and guest speakers from police, defense, and Crown agencies with relevant expertise.

Requirements

Candidates must have an LL.B., J.D., or equivalent, and be a member in good standing of the Law Society of Ontario (or equivalent). Significant experience in Canadian criminal law, particularly in investigating, prosecuting, and defending hate-motivated crimes, is required. Prior teaching experience is an asset.

The Common Law Section reserves the right to select a candidate who does not fully meet the requirements, where the candidate's selection would be beneficial to the program, the course, the students, or for a related reason.
