Job SummaryWe are seeking a highly skilled Commercial Manager to lead the commercial management and life-cycle maintenance for capital projects undertaken by the Capital Projects Group (CPG). The successful candidate will be responsible for supporting the commercial management team throughout the contract lifecycle, ensuring effective and efficient policies, procedures, and best practices are in place to achieve value for money.
Key Responsibilities- Interpret and clarify contractual terms and conditions, in collaboration with Legal Services, which appear unclear or contradictory to the vendor and/or Metrolinx.
- Recommend procurement strategies consistent with overall strategic goals of the CPG Division.
- Monitor commercial performance management through pro-active issue resolution, change requests/amendments, and standardized internal processes that contribute to achievement of desired service levels and Key Performance Indicators (KPIs).
- Produce commercial performance reports and maintain monthly, quarterly, and executive management reports and distribute as needed.
- Author and assist in the review and analysis of the Division's highly complex Capital Project tenders and contract documents to ensure that the appropriate contracting strategy and contractual clauses are applied to reduce risk and protect the interests of Metrolinx.
- Advise vendors, in writing, to remedy defaults where there has been a breach of contract; escalating non-compliance situations to the business unit leaders for further action where necessary and advising of contractual remedies within the contract to address non-compliance.
- Liaise and work collaboratively with Procurement Services and the corporate legal team to prepare complex contractual clauses that align with commercial best practices while meeting program and project objectives.
- Interact with and solicit input from Metrolinx Business Units, Stakeholders, and Vendors to gain necessary buy-in and coordinate contract work to meet stakeholder requirements.
- Identify opportunities for innovation, risk mitigation, and continuous improvement of commercial and contract management, contract administration, and risk control.
- Completion of a degree in Civil Engineering, Contract/Construction Law, or a related discipline - or a combination of education, training, and experience deemed equivalent.
- Demonstrated years' experience in commercial and claims management techniques and practices in a large multi-project complex construction and infrastructure environment.
- Skilled in the development and communication of internal administration policies, procedures, and best practices, preferably in the transit and/or infrastructure industries.
- Extensive experience in the interpretation of contract law, and Ontario legislation (Construction Lien Act, Professional Engineers Act, Canadian Construction Documents Committee documents, bespoke contract documents, specifications, and drawings, and legal statues and proceedings).
- Management and leadership skills to manage departmental staff and lead projects and motivate a team.
