Key Responsibilities:

  • Provide legal representation to the claims department and its insureds on Property and Casualty litigation files.
  • Handle insurance defence files from beginning to conclusion.
  • Prepare and deliver initial reports providing recommendations on liability, quantum assessment, and file management strategy.
  • Advise clients on the need for further investigation and creative options to achieve earlier file resolution.
  • Use civil procedure rules to compel plaintiff document production and early discovery dates.
  • Draft opinions, pleadings, affidavits, and other documents supporting motions applications, mediation briefs, and pre-trial memoranda.
  • Prepare and conduct applications/motions, discoveries, mediations, arbitrations, pre-trial conferences, and trials.
  • Research and advise clients on issues impacting claims.
  • Report to clients following discovery examinations or on receipt of information impacting quantum assessment or early file resolution.
  • Advise clients on developing trends in law.
  • Negotiate settlements with opposing counsel.
  • Provide verbal and written opinions on insurance policy interpretation and coverage issues.
  • Prepare and present educational seminars to the claims department.
  • Maintain productive communications with the claims department and individual adjusters.
  • Work as part of the Litigation Department team to implement programs and procedures to achieve cost-efficient and quality legal services.

Requirements:

  • Member in good standing of the Law Society.
  • Minimum of 2 years of insurance litigation experience, but open to various levels of experience.
  • Experience in legal research and writing, including authorship of legal opinions.
  • Experience in drafting pleadings, conducting discoveries, mediations, application documents, and pre-hearing memoranda.
  • Proficiency in alternative dispute resolution (ADR) processes.
  • Trial experience, particularly independent trial experience, is a definite asset.
  • Excellent verbal and written communication skills, combined with research and negotiation experience.
  • Superior organizational skills, including the ability to handle multiple case files simultaneously.
  • Strong interpersonal skills and the ability to build effective client relationships.
  • Must be Bilingual (English/French) - fluent in both verbal and written.
  • No Canadian work experience required, but must be eligible to work in Canada.
