Position Overview – Early Intervention Counsel
The Canadian Hispanic Bar Association is in search of an Early Intervention Counsel to contribute to its mission. The Early Intervention department plays a crucial role in allowing individuals to express concerns regarding legal practitioners; it evaluates information for regulatory implications and directs cases to the appropriate disciplinary processes or offers constructive feedback and educational opportunities. This initiative aligns with our strategic objective of being a proactive regulator, addressing the competencies of legal professionals while managing disciplinary issues through a fair and transparent process.
The Early Intervention department encompasses activities related to intake, assessment, and resolution. Interactions with this department may arise from general inquiries or specific concerns about a lawyer and can originate from the public, legal professionals, financial institutions, or on behalf of corporate entities.
As an integral member of the Early Intervention team, the Early Intervention Counsel will operate under the guidance of the Senior Manager of Professionalism, responsible for evaluating received information and conveying decisions and justifications to those who have raised concerns. Additionally, the Early Intervention Counsel will provide guidance and educational resources to lawyers as necessary and may facilitate resolutions between lawyers and other parties.
Success in this role demands exceptional communication, time management, judgment, and analytical abilities.
Key Responsibilities
- Evaluate information received and conduct reviews in accordance with established regulations and timelines.
- Conduct research and gather necessary information to support decision-making.
- Assess complaints and determine whether to resolve them, refer them to the appropriate conduct stream, or dismiss them as authorized by the Executive Director.
- Make informed decisions regarding processes and requirements.
- Communicate decisions and rationale to those who have raised concerns.
- Engage with lawyers to discuss client service and improvements in practice.
- Identify risks and trends, providing recommendations to management.
- Maintain a diplomatic, professional, and impartial demeanor when interacting with complainants and legal practitioners.
- Prepare correspondence and complete risk assessments as necessary.
- Collaborate with Conduct Counsel, Legal Counsel, Practice Management Counsel, and other staff to determine appropriate actions.
- Coordinate with the Investigations department to obtain relevant information as needed.
- Professionally communicate with key stakeholders and respond to information requests promptly.
- Develop and maintain a comprehensive understanding of relevant legal regulations and ethical standards pertaining to the assessment process.
Qualifications and Skills
- LL.B. or J.D. degree (or equivalent).
- In good standing with a Canadian Law Society.
- At least 5 years of experience in private practice with substantial client interaction across various legal fields.
- Excellent written and verbal communication skills.
- Proven problem-solving abilities, with a capacity to engage with individuals in a diplomatic and effective manner.
- Ability to prioritize tasks, work under pressure, and meet strict deadlines.
- Training in interest-based mediation is considered an asset.
- Experience applying regulatory thresholds for discipline or similar assessments is advantageous.
- A willingness to grow and adapt to new challenges as they arise in this role.
