Position summary
As a key member of the College’s legal department, the role of legal counsel encompasses a broad range of responsibilities including advising the College on a variety of legal matters related to relevant legislation, College operations, and policies. Reporting to the deputy registrar/chief legal counsel, the individual will oversee all legal matters in accordance with the Health Professions Act (HPA), College Bylaws, policies and procedures.
This position will primarily support the complaints and practice investigations department in order to support the activities of the Inquiry Committee (Panels B, C, D and E) in collaboration with the other legal counsel, legal services.
Duties and responsibilities

**Duties include but are not limited to the following**:
Inquiry committees
- attend Inquiry Committee and agenda review meetings and provide additional legal advice and support regarding legislative interpretation, relevant legal precedents, charging standard and statutory options available for disposition of complaints to promote fair and transparent processes
- ensure that committee investigation reports include robust analysis, which is reflected in each panel’s discussion and decision
- investigate and synthesize facts and legal issues for written and oral presentation to the Inquiry Committee regarding range of complaint files
- review minutes and resolutions arising from the meeting and draft post meeting resolutions and correspondence setting out reasons and directions to assist the Inquiry Committee
- where remedial or disciplinary action is directed, draft undertakings, reprimands, citations, orders, consent agreements, and press releases
- advocate and represent the College at committee hearings, working with external legal counsel where appropriate

Complaints and practice investigations department support
- engage in process analysis and systems enhancements, review with view to ensuring consistency, efficient resource management and compliance with legislation and HPRB guidelines
- advise and respond to requests for legal opinions relating to complaint intake and triage, requisite authorizations for release of confidential information, alternative dispute resolutions opportunities and public notification of outcomes post disposition of complaint matter
- lead through systemic changes to be required by Indigenization initiatives and enhanced accessibility to youth complainants

Bylaw amendments
- assist College departments with Bylaw interpretation and amendments
- draft amendments to the College Bylaws
- collaborate with the College’s registrar and the Ministry of Health regarding proposed Bylaw amendments
- ensure compliance with statutory notice periods regarding the proposed amendments
- collaborate with the communications and public affairs department regarding the posting and notification of the Bylaw amendments to registrants and other regulatory authorities

Administration and other responsibilities
- promote teamwork and sharing appropriate information with staff in a timely manner
- conduct regular meetings with complaints and practice investigations to address inquiries and provide ongoing support and legal advice on process, procedural fairness and legislative requirements
- assist with implementation of legal department procedures and resource management
- perform such other duties, functions, and responsibilities as assigned by the College’s deputy registrar/chief legal counsel

Skills and qualifications

**Required skills and qualifications include**:

- LLB and member in good standing with the Law Society of British Columbia or eligibility for membership in the Law Society of British Columbia
- three to five years’ recent practice experience with direct experience within the regulation of health professions
- knowledge of the law of professional regulation and familiarity with medicolegal issues
- ability to handle a heavy, complex, diverse caseload in a fast-paced legal environment
- ability to work respectfully with staff at all levels and with committee members
- ability to review large quantities of evidence and procedures to advise on outcomes
- ability to negotiate regulatory outcomes with defence counsel and unrepresented parities to achieve conclusion that will withstand HPRB scrutiny
- ability to deliver on-time legal advice to staff and committee members that is thorough, accurate, and comprehensible
- ability to absorb, comprehend, and retain a body of law and precedent to advise staff and committees on issues arising
- superior interpersonal skills, able to work with colleagues to author and achieve policies and procedures that will withstand legal challenge
- ability to multi-task within own area of responsibility and in support of other departments as required
- ability to quickly identify legal issues and provide practical advice
- ability to use initiative and take appropriate action when unforeseen circumstances aris
