**Position Overview**:
Reporting to the General Counsel, the Legal Counsel (Labour and Employment) will play a pivotal role in managing and providing strategic guidance on complex labour and employee relations matters. This position is essential in shaping effective strategies, resolving escalated issues, and building positive, collaborative relationships with labour unions and employees. This role demands a strong understanding of labour relations, including expertise in collective bargaining agreements, arbitrations, and mediations. Acting as a trusted advisor and project manager, the Legal Counsel will ensure that Flair delivers proactive, knowledgeable support in these critical areas while contributing to the company’s most important initiatives. The role is based in Vancouver, BC, Calgary, AB, or Edmonton, AB, with occasional travel required. Some evening and weekend work may also be necessary.
**Primary Job Functions**:
The duties of the **Legal Counsel**include:
**Labour Relations Strategy**:
- Develop and implement labour relations strategies aligned with the Company’s business objectives as it relates to collective bargaining
- Represent Flair in labour arbitration (both in traditional and expedited formats), and in litigation before the Courts as well as the Canada Industrial Relations Board and the Canadian Human Rights Tribunal or their provincial counterparts
- Drafting and reviewing correspondence and hearing documents (briefs, witness statements, written arguments, motion records, settlement documents, etc.)
- Gathering and reviewing the information necessary to respond to inquiries, complaints and grievances
- Advising on collective bargaining matters and supporting bargaining teams in reaching advantageous agreements
- Providing advice on a variety of employment law-related matters to Human Resources Department
**Collective Bargaining**:
- Lead or support collective bargaining negotiations with unions, including preparation, strategy development, and drafting of agreements in consultation with Flight Operations Management
- Collaborate with internal stakeholders to ensure alignment during negotiations
**Union Management**:
- Foster effective working relationships with union representatives
- Manage grievance and dispute resolution processes, providing recommendations to achieve mutually beneficial outcomes
- To represent the Company in grievances and arbitration hearings
- To represent the Company at various external agencies and arbitration/mediations
**Compliance and Reporting**:
- Ensure compliance with the Canada Labour Code, human rights legislation, and other applicable regulations in the aviation industry
- Maintain accurate records of labour relations activities and prepare reports for senior management
**Employee Relations**:
- Partner with Human Resources to advise on employee and labour relations, including disciplinary actions and terminations, to ensure fair and consistent treatment of employees
- Support workplace investigations and provide guidance to resolve employee concerns effectively as needed
**Industry Insights**:
- Stay updated on trends, legislative changes, and emerging best practices in labour relations within the aviation sector
- Provide insights on the impact of industry-specific regulations on labour relations
**Qualifications & Requirements**:
- ** Education**:
- Law degree from an accredited law school.
- Member of the Bar for at least 7-10 years in one of the Canadian provinces or territories
- ** Experience**:
- A minimum of 7-10 years of labour and employment practice in a law firm or large corporate environment, with a successful track record of providing legal advice on a broad range of issues
- Preferred experience in the aviation industry
- ** Skills & Abilities**:
- Strong negotiation and advocacy skills in grievance arbitration, labour board proceedings, and employment-related litigation
- Proven expertise in collective bargaining and effectively managing unionized work environments
- Excellent communication and interpersonal skills, with the ability to build relationships and collaborate effectively with internal and external stakeholders
- Demonstrated organizational skills and the ability to maintain a high level of accuracy and attention to detail
