Indigenous Court Worker

**Position Summary**:
The Court Worker helps Indigenous people to understand their rights, legal options, responsibilities and court procedures. Their work involves providing non-legal information about the courts to the accused; preparing and accompanying the accused to court; speaking about the potential sentence; providing referrals to appropriate services and programs; liaising between the accused and criminal justice officials; and promoting restorative justice and other community-based justice programs.
**Responsibilities**:
- Identify individuals requiring services at court, referral or other means of contact.
- Interview client to seek information to collect for reporting, explaining the charge; explaining the court processes; e.g. Release, remand, release conditions, adjournment.
- Travel occasionally to other court locations within STC jurisdiction.
- Explain to the accused the reason(s) for their charges and provide general information on legal rights (e.g. right to counsel) with emphasis on early intervention options and responsibilities in regard to the charge(s).
- Speak to Crown to get Crown position on sentencing; provide information regarding accused to Crown.
- Assist client to review disclosure, speak to sentence, and understand role of parties in sentencing.
- With client consent, explain to the client’s family the judicial procedures and steps taken regarding the accused by the justice system.
- Liaise with agencies for the accused, particularly the police, defence counsel, the court and the Crown, to ensure that they have all the information necessary to deal fairly with the accused.
- Provide information to the court regarding applicable Gladue factors prior to sentencing.
- Find out if the client requires an interpreter or translation services and make necessary arrangements.
- Find out if the client requires an adjournment, why and timeline.
- Explain to the client the nature and meaning of any measures taken by the court (such as judicial sanctions, bail, detention or conditional release).
- Conduct interviews with witnesses or references to assist in understanding the immediate circumstances of the client’s position.
- Assist accused in tracking charges, arranging for voluntary appearances, transferring/waiving charges for pleas, etc.
- Provide monthly statistical reports and other periodic reporting as required by management.
- Be available in court to provide appropriate information about the accused to defence counsel, the judge and the Crown as well as help clarify matters for the accused. This may include speaking as a “friend of the court” or “agent” as defined by _The Department of Justice Ac_t on behalf of an accused.
**Education and Experience**:
- Successful completion of social worker, human justice or sociology degree/diploma; AND
- Minimum One (1) year experience in a justice related field; AND
- Certification in Court Worker Levels 1 and 2 or ability to challenge the certification exam; OR
- Equivalent combination of education, training and work experience will be considered.
- Experience working within a governance structure in a community development capacity with First Nations or familiarity with First Nations culture, protocol and history is considered an asset.
**Knowledge, Skills and/or Abilities**:
- Knowledge and understanding of criminal justice system.
- Knowledge of provincial court system.
- Knowledge of Gladue principles as it relates to the justice system.
- Excellent verbal and written communication skills, including the ability to establish and maintain effective working relationships.
- Analytical, decision making and the ability to recognize challenges, identify causes and provide solutions.
- Dependability: able to work independently, submit accurate documentation, and seek guidance when needed.
- Receptive: accept feedback, take ownership of responsibilities, and identifies areas of growth.
- Interpersonal Skills: communicates clearly, seek solutions, and demonstrates flexibility.
- Integrity: keep sensitive information confidential and adheres to STC’s policies.
- Ability to speak an Indigenous language is an asset.
**Other**:
- Must provide a current, original, Canadian Criminal Record Check (CCRC) with vulnerable sector search as a condition of employment; AND
- Must possess a valid Saskatchewan Driver’s license and meet STC’s insurance requirements;
