**Job Description**:
***:Under the direct supervision of the City Solicitor for the purposes of Provincial Offences, is accountable for the prosecution of offences under Provincial, some Federal statutes and Municipal by-laws and to perform all related administrative duties related to the prosecution of offences under the Provincial Offences Act for the Thunder Bay Court Service Area.
**MAJOR RESPONSIBILITIES**:
- Conducts prosecutions of charges laid under Provincial statutes, Contraventions Act and Municipal By-laws in accordance with accepted prosecutorial practices and standards.
- Evaluates charges and ensures relevant evidence has been collected.
- Determines whether to proceed with prosecution, to withdraw charges or to charge.
- Researches and prepares cases for oral and/or written presentation before Provincial Offences courts.
- Manages requests for disclosure, makes sentencing recommendations, arranges for witnesses and interpreters
- Responds to inquiries, provides information, and maintains effective and co-operative working relationships with other officials in the justice system, City staff, other municipalities and agencies, ministry officials, enforcement officials and general public.
- Represents the City as respondent or appellant in the higher courts on matters relating to appeals under the Provincial Offences Act.
- Monitors and schedules contract prosecutors.
- Performs such other related duties as may be assigned.
**QUALIFICATIONS**:
**Education/Experience**:
- Degree or diploma in a related field; and
- Five years’ related legal and/or court experience
- Experience in law enforcement and a legal environment as either a prosecutor or defense counsel
**Skills/Abilities**:
- Knowledge of the Court System as required in the POA environment
- Knowledge of various Provincial legislation such as the Highway Traffic Act, Liquor Licence Act, Compulsory Automobile Insurance Act and Municipal By-Laws
- Proven analytical, organizational and time management skills
- Ability to deal tactfully and effectively with the judiciary, legal profession, police and public
- Excellent oral, auditory, comprehension, negotiation and written communication skills (in English)
- Competence in decision making
- Excellent interpersonal skills
- Ability to maintain and display professional conduct at all times
- Competence within the meaning of the Ontario Occupational Health and Safety R.S.O 1990 Chapter 0.1 as amended
- Must possess and maintain a valid Class “G” Ontario Drivers Licence, or equivalent
- Must meet the definition of a competent driver as defined by the Corporation
**Assets**:
- Experience working with the ICON/IJP systems (Integrated Court Offences Network/Integrated Justice Program)
- Bilingualism
**CONDITIONS OF EMPLOYMENT**:
- Must remain a competent driver as defined by the Corporation
- May be required to provide a successful driver’s record (uncertified)
- Will be required to travel to various work locations and provide own transportation
- Must be able to travel, via vehicle and/or air, to satellite court locations as required
- Must take an Oath of Secrecy
- Must undergo a successful Criminal Record and Judicial Matters Check (CRJMC)
