The Office of the Worker Adviser (OWA) is searching for a skilled legal professional who can represent clients in health and safety reprisal cases. As a Worker Representative, you will deliver the OWA's health and safety reprisals mandate by providing service and support to clients at all stages of the health and safety reprisal complaint process.

Effective January 1st, 2024 the salary range of this position is**$1,704.77 to $2,224.14 per week**in compliance with OPSEU Unified Bargaining Unit collective agreement provisions. The new rates, effective retroactive to January 1, 2024, were recently confirmed and dates for implementation of the new salary rates are still to be determined.

**What can I expect to do in this role?**: As part of this professional team, you will:

- work on files related to Workplace Safety and Insurance Board (WSIB) claims from early resolution up to and including Workplace Safety and Insurance Appeals Tribunal (WSIAT) appeals and hearings.
- use OWA case management systems to record and manage work while complying with OWA procedures.
- advise and direct workers, survivors, their families and community partners regarding issues and evidence required for successful resolutions.
- investigate events and circumstances of claims by obtaining and analyzing relevant documents and conducting interviews.
- prepare clients and witnesses for mediations and hearings.
- represent clients before the WSIB, WSIAT and Ontario Labour Relations Board (OLRB).
- develop community outreach plans.

**How do I qualify?**:
**Mandatory**:

- You are licensed by the Law Society of Ontario and entitled to provide legal services in Ontario.
- You must possess oral and written French language skills at the advanced level. Your proficiency level will be confirmed before hire.

Please Note: this position requires province-wide travel and the ability to work irregular and extended work hours

**Technical Knowledge**:

- You have knowledge of the Occupational Health and Safety Act (OHSA), Ontario Labour Relations Board policies, procedures and case law to advise and represent applicants in health and safety reprisal complaints.
- You have demonstrated knowledge of the Workplace Safety and Insurance Act, and related legislation to advise and represent on WSIB appeals.
- You have knowledge of medical and legal terminology as it relates to workplace insurance matters.
- You have knowledge of alternative dispute resolution and negotiation techniques to promote early resolution.
- You have knowledge of substantive and procedural law applicable to adversarial and inquisitorial quasi-judicial proceedings.
- You have general employment law experience and/or knowledge (e.g. wrongful dismissal, employment standards, human rights, workplace safety and insurance) to make appropriate referrals and advise workers.

**Research, Analysis, Investigative and Problem-Solving Skills**:

- You can probe in interviews, gather and assess case information and evidence.
- You can analyze information to assess viability of each case and develop case strategies and arguments to guide, counsel and represent clients in negotiations and at hearings.

**Oral and Written Communication Skills**:

- You can marshal facts, articulate issues, interview witnesses, represent clients, explain and persuade and deal effectively with vulnerable workers who may be in financial or psychological crisis and prepare effective submissions for administrative tribunals.

**Team Work, Leadership and Relationship Management Skills**:

- You can provide input to other cases and develop improved procedures.
- You can ensure quality service and bring about successful conclusions to cases.
- You can quickly establish working relationships and client confidence.
- You can work collaboratively and effectively with other team members and external partners to achieve program objectives.

**Case and Project Management Skills**:

- You have demonstrated organizational and project management skills to manage a caseload and meet deadlines in a high-volume environment.
