OMVIC currently has a vacancy for a Prosecutor (one year contract) for our Toronto corporate office. Who is OMVIC OMVIC (Ontario Motor Vehicle Industry Council) is Ontario’s vehicle sales regulator. OMVIC enforces the Motor Vehicle Dealers Act and other consumer protection statutes for the Ministry of Public and Business Service Delivery and Procurement. OMVIC’s mandate and role is to maintain a fair and informed marketplace by protecting the rights of consumers, enhancing industry professionalism, and ensuring fair, honest, and open competition for registered motor vehicle dealers. This is achieved by maintaining strict dealer/salesperson registration requirements; inspecting all Ontario dealers (new and used); providing free complaint handling to consumers; developing/delivering consumer and dealer education/awareness programs; and investigating and prosecuting industry non-compliance and illegal sales (curbsiding). Position Information Reporting to: Senior Legal Counsel/Assistant General Counsel. Salary Range: $85,000 – $135,000 annually. Work Model: Hybrid – requirement of 2 days per week/8 days per month in office. All duties carried out remotely must be completed from the employee’s approved home office within Ontario. Position Summary The Prosecutor is responsible for conducting prosecutions ranging from routine to complex, under the Provincial Offences Act; and is responsible for prosecutions from their initiation to their final disposition as well as to represent the prosecution in the administration of justice in the Province of Ontario with respect to charges laid by investigators of OMVIC. Responsibilities Review the evidence supporting the charges laid and assess whether any further investigation is required. Manage case tracking, dispositions, court dates, and witness notifications. Prepare and deliver disclosure. Conduct pre-trial meetings and resolution discussions; liaise with court officials, OMVIC staff and non-staff witnesses. Represent prosecution in trial and appeal courts: present arguments, examine witnesses, respond to Charter issues. Perform other duties as required. Qualifications A Lawyer or Paralegal in good standing with the LSO. At least three years of litigation experience conducting prosecutions, including proceedings under the Provincial Offences Act. Knowledge of structure and jurisdiction of Courts and rules of practice, procedure and evidence. Knowledge of the Provincial Offences Act and other relevant statutes such as the Motor Vehicle Dealers Act, 2002, the Consumer Protection Act, 2002, the Ontario Evidence Act and the Canadian Charter of Rights and Freedoms. Knowledge related to precedents to evaluate evidence, interpret and apply statutes. Experience with techniques for conducting investigations, interviewing and communicating with lay-witnesses and expert witnesses. Experience with common office software including MS Office (Word, Excel, PowerPoint) and legal research platforms like Lexis-Nexis.
