Calian recherche un Enquêteur (Investigateur) pour assister notre client dans la facilitation de son projet. Ce rôle inclut pour faire enquête sur un incident de harcèlement et de la violence en milieu de travail.

Responsabilités
Le fournisseur de services doit :
• Communiquer rapidement avec le gestionnaire délégué ou son représentant pour discuter de l’incident présumée, des limites de temps, de la méthode d’enquête et de la convocation des témoins et des parties concernées, et de l’accès aux locaux et aux documents de l’ARC liés à cette enquête ;
• Aviser les parties concernées de la confidentialité du processus ;
• Mener l’enquête en tant qu’enquêteur nommé en vertu de l’article 28 du Règlement sur la prévention du harcèlement et de la violence dans le lieu de travail ;
• Mener l’enquête en toute confidentialité et neutralité ;
• Rencontrer (en personne, par téléphone ou par vidéoconférence) les témoins et les parties concernées afin de recueillir les faits liés à l’incident présumée ;
• Permettre aux parties et aux témoins d’examiner leurs déclarations aux fins d’exactitude ;
• Recueillir et analyser tous les faits pertinents concernant l’incident présumée de harcèlement et de violence dans le lieu de travail ;
• Informer le gestionnaire délégué ou son représentant dans le cas où les parties concernées ne participent à aucune partie du processus d’enquête ;
• Consigner par écrit les déclarations à la suite des conversations avec les témoins et les parties concernées ;
• Consigner les sommaires des discussions et toutes les preuves documentaires utilisées pour prendre une décision, faire des conclusions ou des recommandations ;
• Tirer des conclusions et formuler des recommandations de mesures de préventives pour empêcher qu’un incident de harcèlement ou de violence dans le lieu de travail se produise

Qualifications
• Au cours des dix (10) dernières années, doit avoir réalisé au moins cinq (5) projets de services d'enquête en tant qu'enquêteur principal, unique ou co-enquêteur concernant le harcèlement et la violence en milieu de travail, dans le secteur privé ou public. . Tous les projets doivent répondre aux 5 indicateurs d'évaluation ci-dessous :
o Expérience liée aux enquêtes sur le harcèlement et la violence en milieu de travail
o Expérience dans l'application des lois ou règlements fédéraux, provinciaux ou territoriaux en matière de travail ou des politiques sur le harcèlement et la violence.
o Expérience dans l'application de la Loi canadienne sur les droits de la personne
o Expérience dans la conduite d'enquêtes sur le lieu de travail, y compris des enquêtes complexes
o Expérience en rédaction de rapports d'enquête
• Doit avoir animé ou suivi au minimum des cours/formations/ateliers dans les quatre domaines suivants :
o Techniques d'enquête administrative ;
o Loi canadienne sur les droits de la personne ;
o Le droit canadien du travail et le droit de l'emploi pertinents, y compris la partie II du Code canadien du travail ; ET
o Formation relative au harcèlement et à la violence en milieu de travail.
• Doit avoir animé ou complété les cours/formations/ateliers dans l'un des domaines suivants :
o Arbitrage
o Modes alternatifs de règlement des litiges/médiation/conciliation
o Questions interculturelles et de diversité
o Conseil / coaching
o Sociologie
o Psychologie industrielle
o Principes de raisonnement éthique

• Doit avoir obtenu le titre professionnel/licence dans l'un des domaines suivants :

• Doit fournir une preuve d'éducation d'une université, d'un collège/CEPEG ou d'une école secondaire

Position Overview
Calian is seeking an Investigator to assist our client with the facilitation of their project. This role includes investigating an incident of harassment and violence in the workplace.

Responsibilities
The service provider must:
• Communicate promptly with the delegated manager or his representative to discuss the alleged incident, time limits, method of investigation and summoning of witnesses and parties concerned, and access to premises and documents from the CRA related to this investigation;
• Advise the parties concerned of the confidentiality of the process;
• Conduct the investigation as an investigator appointed under section 28 of the Regulations on the Prevention of Harassment and Violence in the Workplace;
• Conduct the investigation in complete confidentiality and neutrality;
• Meet (in person, by telephone or by videoconference) with witnesses and affected parties in order to gather the facts related to the alleged incident;
• Allow parties and witnesses to review their statements for accuracy;
• Collect and analyze all relevant facts regarding the alleged incident of harassment and violence in the workplace;
• Inform the delegated manager or his representative in the event that the parties concerned do not participate in any part of the investigation process;
• Record in writing statements following conversations with witnesses and relevant parties;
• Record summaries of discussions and all documentary evidence used to make a decision, conclusions or recommendations;
• Draw conclusions and make recommendations for preventative measures to prevent an incident of harassment or violence in the workplace from occurring

Qualifications
• Within the last ten (10) years, must have completed a minimum of five (5) Projects of Investigative Services as lead, sole investigator or as co-investigator relating to harassment and violence in the workplace, in either the private or public sector. All Projects must meet all 5 Evaluation Indicators below:
o Experience related to harassment and violence investigations in the workplace
o Experience applying federal, provincial or territorial labour acts or regulations or harassment and violence policies
o Experience applying the Canadian Human Rights Act
o Experience conducting workplace investigations including complex investigations
o Experience writing investigation reports
• Must have facilitated or completed at a minimum courses/training/workshops in all four following areas:
o Administrative Investigative Techniques;
o Canadian Human Rights Law;
o Relevant Canadian Labour Law and Employment Law, including the Canada Labour Code Part II; AND
o Training related to harassment and violence in the workplace.
• Must have facilitated or completed the courses/training/ workshops from any of the following areas:
o Arbitration
o Alternative dispute resolution/mediation/conciliation
o Cross-cultural and diversity issues
o Counselling / coaching
o Sociology
o Industrial psychology
o Principles of ethical reasoning
o Self-management
o Occupational health and safety / Harassment and violence prevention
o Mental health
o Domestic violence
o Cyberbullying
o Legal
• Must have obtained the Professional Designation/License from any of the following areas:
o Mediation / conciliation
o Occupational health and safety
o Psychology
o Social Work
o Human Resources

• Must provide proof of education from University, College/CEPEG, or high school
• Must be fluent in reading and writing in French
