Diales Canada provide consultancy, dispute resolution and commercial services, including construction and engineering claims for delays, disruption, additional costs, disputed additional work and other relevant issues to international engineering and construction companies, owners, financers, insurers, and other construction industry clients.

The role:

Diales Canada are seeking to appoint an experienced and dynamic Lead Expert to join our growing team in Toronto.

As the Director/Lead Expert you will be responsible for managing and leading a team of professionals to assist clients through complex issues as related to the construction industry.

As the Lead Expert you will have demonstrable experience working as a construction claims consultant on major high value disputes, including expert witness testimony experience.

Main duties will include (but not be limited to):

  • Developing, leading, and mentoring a team of construction claim professionals of varying degrees of experience.
  • Developing existing and new relationships within the construction and legal industry to bring in fee earning work.
  • Undertaking and leading fee earning assignments with respect to live and retrospective claims and disputes.
  • Meeting with clients and client’s legal counsel in connection with dispute related work.
  • Preparing mediation, settlement, and expert reports relating to duty of care in the construction industry, project management, change management, scheduling, delay, disruption, quantum and related issues.
  • Providing expert testimony on matters including project management, delay, disruption, quantum, and related issues.
  • Advising clients on commercial strategy, risks, and opportunities.
  • Creating and presenting claims related presentations to various. parties within the construction industry.

Key candidate criteria:
  • A degree in Engineering, Architecture or Quantity Surveying and the ability to be qualified by the relevant professional body in Ontario.
  • Experience as an appointed Expert Witness in adjudication, arbitration or litigation proceedings with lawyer references available. Those that have been cross-examined, although not essential, would possess an advantage.
  • Strong leadership and team building skills.
  • Established contacts in the engineering, construction, and legal communities in Canada with a focus on the Toronto market.
  • Demonstrable experience of identifying, bidding, securing and completing construction claim related fee earning work in Canada with a focus on the Toronto market.
  • Strong and successful track record in business development.
  • Excellent written and verbal technical communication skills in English.
  • Excellent public speaking skills.
  • Willingness to be engaged with construction industry organizations.
  • Willingness to travel both domestically and internationally when required.

Additional criteria which would be advantageous by not essential for candidates:
  • A Master of Laws (LLM) or other legal education
  • MEng, MBA and/or post-graduate qualifications
  • Recognized certification as either a PSP or a CFCC with AACE International
  • Publication of peer reviewed papers
