The Commercial Contracts Manager will be responsible for providing world class support from tendering to final project completion, ensuring a balance of customer centricity and risk management. This role will develop, negotiate, review and approve non-standard contractual terms and conditions. Responsible for end to end contract negotiation for edits and custom contract terms requested by customers, collaborating with cross functional stakeholders.

The Commercial Contracts Manager will educate the sales organization by providing risk analysis of contractual terms and exceptions to support growth of region financially & in terms of capability by building the risk management mind-set within the broaden regional team & influencing change at the global level.

Duties & Responsibilities:
Provide, review, and analyze key issues + assess risk in commercial contracts, developing mitigation strategies for negotiations and sometimes leading them in complex contracts and collaborates with sales and business to create contractual solutions.Negotiates contracts in partnership with Sales, Finance and other functional leads to achieve timely deal closure and growth expectations.Combines business and legal expertise to create innovative custom contract solutions to meet business objectives; evaluates and interprets contract compliance and advises others on contractual rights and obligations, applying and recommending best practices.Prepare persuasive positions for (and sometimes lead) complex contract negotiations for dispute resolution and change order requests with customers and suppliersSupport the development and implementation of risk management processes and controls working with Project Management / Services leadershipProvide project summaries and guide Project Managers / Services leaders through successful project execution strategies in high risk projects / dealsReview, negotiation, and approval of Non-Disclosure Agreements as necessary to support proposal effortsConsult with the Legal Team as necessary to support contract negotiations and dispute resolutionProvides guidance on contractual terms, policies and procedures to sales organization, project managers and other operational/legal support staff, including training on contracting practices and procedures.
Required Education & Experience:
Must have 5+ years of experience in the Nam Region with a strong understanding and experience of Legal and Contractual terms & ConditionsBachelor's degree- Legal, Business, or Engineering8+ years of commercial or transactional legal/contract negotiation experienceFluency in English (French is a plus) and the ability to draft and negotiate in this languageExperience working with Design-Build (EP, or EPC) contractors and contractsProven Working knowledge of contract forms NEC, ICHEM, FIDIC or EJCDC, CCDCKnowledge of legal terminology and concepts as used in commercial contractsExperience with direct customer contact and negotiations - written and verbal/presentation
Preferred:
General understanding of water treatment technologies and customer industries and operationsSubstantive knowledge of commercial contracts in NAM businessCertified Federal Contracts Manager (CFCM)Experience working in a matrix organization with multiple stakeholders
Travel:
Travel estimated at 20% (international travel likely)
