Hitachi Énergie est à la recherche d’un gestionnaire de contrats (ententes contractuelles avec le client) pour son bureau de Montréal. Dans le cadre de vos fonctions, vous serez responsable de la gestion des contrats pour les projets d’ingénierie, d’approvisionnement et de construction (EP ou EPC) de l'unité opérationnelle Réseaux électriques - Intégration de réseaux (PGGI) à l'échelle de l’Amérique du Nord.
Assurer l’exécution précise et en temps voulu des activités de gestion des contrats pour le portefeuille de contrats attribués, y compris, sans s’y limiter, les contrats EP ou EPC avec les clients/propriétaires, et éventuellement les contrats de consortium ou les contrats de sous-traitance majeurs (civils/installation) au besoin.
En étroite collaboration avec les équipes de projet, les services juridiques et la gestion des contrats, diriger les responsabilités de gestion des contrats par le truchement de la proposition, la formation, l’exécution, l’administration, la gestion des changements/réclamations, la clôture, la garantie et les litiges.
Mettre en place des stratégies de réclamation, préparer des avis, de la correspondance et d’autres documents contractuels applicables en coordination avec l’équipe de projet (modifications, demandes de modification, etc.).
Faire appliquer et défendre les intérêts contractuels de PGGI, y compris le suivi et l’évaluation des changements et des déviations conformément aux exigences contractuelles et à l’instruction de gestion des contrats de PGGI.
Informer les Services juridiques des réclamations majeures et des développements critiques pendant l’exécution du projet et assurer la liaison avec eux.
Préparer la matrice des éléments livrables contractuels et présenter la partie contractuelle lors des réunions de lancement du projet.
Diriger les négociations et les règlements des contrats et des réclamations en collaboration avec la direction du projet et les Services juridiques, le cas échéant.
Fournir des conseils et du soutien à l'unité opérationnelle, à l'équipe de direction de projet, à la direction de site, au service approvisionnement/chaîne d’approvisionnement et aux autres membres de l’équipe de projet pendant le cycle de vie du contrat afin de garantir les droits contractuels de PGGI, et autres droits qui en découlent.
Collaborer avec le service juridique et la chaîne d’approvisionnement/sous-traitance pour définir les dispositions relatives au flux des contrats des clients.
Soutenir et participer aux réunions hebdomadaires et mensuelles sur l’état d’avancement du projet avec l’équipe de projet, les clients, les sous-traitants et les fournisseurs, le cas échéant.
Encadrer les membres de l’équipe de projet en matière de sensibilisation commerciale, de contrats et de gestion des réclamations.
Préparer un rapport exécutif mensuel sur les coûts supplémentaires globaux et l’état des réclamations pour les projets en cours d’exécution.
Habiletés à lire, écrire, parler et négocier en français et en anglais
Solide expérience en matière de gestion du changement, de gestion des réclamations et des questions juridiques liées aux contrats, ainsi que des effets possibles dans les domaines de responsabilité pertinents concernant l'étape de proposition et/ou l’exécution du projet
Aptitude à interagir avec le client et les sous-traitants concernant toutes les questions liées aux contrats et aux projets, y compris celles relatives à l'examen et au processus de traitement des modifications.
Sens commercial, aptitudes de négociation et démarche proactive de la résolution de problèmes
Aptitude à travailler au sein d’équipes dotées d’un personnel international et avec des partenaires contractuels internationaux.
Être disposé à travailler ou à se rendre sur des sites ou des bureaux de projet nationaux, et peut-être internationaux, pour de courtes ou de longues périodes.
Un doctorat en droit ou une formation juridique est souhaitable, mais non exigé.
Expérience en matière de production d'énergie, de projets EPC, de sous-stations, de postes de conversion, d'intégration au réseau, de transmission ou de fonctions de gestion de contrats d'installations industrielles similaires (l'accent étant mis de préférence sur les installations civiles et électriques), de processus et de gestion/administration d’ententes contractuelles de tailles et de types variés.
