Course Information

This course will provide an introduction to the legal aspects of construction including standard forms of contract; tort and liability; bonds and insurance; lien acts; dispute resolution; procurement law; professional liability; zoning and land use regulations; acquisitions and transactions; leases; and the protection of intellectual property. Students will also learn how to identify and modify one-sided contract elements and negotiate favorable terms. Governance structures and the regulatory environment will also be discussed with a particular focus on the project approvals process and potential site limitations.

a) A part-time hourly appointment/ one semester is for less than 9 hours in any one semester.

PLEASE NOTE: Pursuant to the University's and as a condition of employment, all successful candidates will be required to either submit valid proof of vaccination against COVID-19 or receive a . Course delivery in Fall 2024/Winter 2025 will be online, in-person or hybrid at the sole discretion of the hiring unit. Candidates hired for in-person courses will be required to carry out their teaching on campus. Candidates teaching remotely are required to have access to the appropriate technology, i.e. computer with camera and microphone and high-speed internet.

Education and Relevant Experience

Applicants must possess an accredited degree in Law (Bachelor of Laws Degree (L.L.B.) or Juris Doctor (J.D.) with experience in Contract law OR a degree in planning, architecture, engineering, or a related field, complemented by significant experience working in a regulatory environment and/or navigating contractual and regulatory issues; applicants with business degrees and a demonstrated track record of contract negotiation within the AEC context may be considered.

Practice Field Experience 

Applicants must have a minimum of at least five (5) years field experience working in a legal or regulatory environment in the design and construction sector, for example, working for the City Planning Department or as a lawyer working for or with AEC firms. 

Currency

Applicants must demonstrate current understanding of the architectural field and the particular issues related to this course through professional practice, publications, and/or participation in relevant conferences (within the past five years).

Current DAS CUPE 1 Lecturers are expected to provide an updated currency report to be considered for contract lecturer positions as per article 17.(h) of the collective agreement.

Teaching Skills

Applicants must have demonstrated post-secondary teaching experience related to techniques commonly used in the negotiation of contracts, interpreting regulations, and/or procurement law.

Applicants should demonstrate commitment to inclusive teaching and awareness of EDI priorities, including but not limited to demonstrated ability to make learning accessible and inclusive for a diverse student population; and incorporating course materials and/or guest lecturers to provide different knowledge, perspectives, lived experiences and worldviews.

Applicants must demonstrate proficiency in all aspects of personal computers that are relevant to this course, including document creation, file management, internet research, and communications.

Interactive Skills

The MPMBE is an experiential and critical thinking-centered program; as a result, case-based learning is a core pedagogical method in the curriculum and should be integrated into course delivery. The use of active role play and debate would also be highly suitable for this context.

Demonstrated ability to effectively interact with colleagues and students; ability to work effectively in groups; ability to resolve conflicts constructively; ability to carry out the duties and obligations of an Instructor in a respectful manner; ability to empathize with others and consider varied perspectives; commitment to on-going self-assessment; effectively facilitate respectful classroom discussions addressing diverse student identities, perspectives and experiences.

Applicants are to submit samples of teaching work and/or design/creative/professional work or other documents that demonstrate work they have undertaken in the proposed area of focus.
