Legal Counsel I is a complex and responsible position whose primary function is representing and advising the MGEU in respect of legal matters and dealing with all aspects of arbitration preparation and presentation. The incumbent will be responsible for representing the MGEU at the Manitoba Labour Board and various courts of law on all matters pertaining to labour and administrative law. This position reports to the Director, Member Services.

Responsibilities
  • Prepare cases for interest and grievance arbitration including legal research, interviewing witnesses, selection of arbitrators, case and hearing conduct, and case management.
  • Present cases to appeal panels, arbitration boards, Manitoba Labour Board, and various levels of court.
  • Represent the Union in the Court of King's Bench and Court of Appeal respecting various matters including judicial reviews, injunction applications, and inquiries.
  • Provide legal opinions to the Union on matters pertaining to grievance arbitration, Labour Board matters, and collective bargaining matters, including strikes.
  • Prepare legal documents and briefs for Manitoba Labour Board, Court of King's Bench, and the Court of Appeal.
  • Provide technical legal advice to other staff on grievance and arbitration matters.
  • Prepare and teach workshops. Building organizational capacity by developing training workshops for MGEU staff and members.
  • Sit as a member of the Union's Screening Committee and represent the Screening Committee to the Union's Grievance and appeals Committee as required.
  • Other duties as assigned.
Qualifications
  • A Bachelor of Law Degree (LLB or JD) and Call to the Bar in Manitoba, with current license to practice in Manitoba.
  • Minimum five (5) years experience practicing labour law including conducting arbitration and Labour Board proceedings.
  • Thorough knowledge of general labour and employment law as it pertains to unionized workplaces.
  • Experience in analysis and interpretation of labour related decisions, awards, and legislation.
  • Able to analyze and identify grievance file issues.
  • Able to express principles, analyze awards and judgements, and make recommendations clearly and concisely, both orally and in writing.
  • Able to work with minimal direction and supervision with a high degree of initiative.
  • Conflict resolution skills; able to apply dispute resolution techniques in situations of diverse conflict.
  • Ability to communicate effectively with members, other staff, and a broad range of stakeholders.
  • Understands the goals and values of the labour movement.
  • Able to work flexible hours including evenings and weekends when required.
  • Able to travel from time to time.
