We are currently looking for a Contract Manager to join our Eglinton Crosstown West Extension - Station Box Works project.
The Contract Manager will provide support in the effective administration of the prime contract between the company and its customer including providing sound contractual advice to the project team to minimize any risk to the company and to ensure optimal outcomes for the project. The individual will be responsible for all contract matters including interpretations, risk management, change management, claims, dispute resolution and negotiations related to the Company's contract with the client. The individual will have intermediate to senior level knowledge in order to work independently and under the direction of the project's senior management team. The individual will work collaboratively with multiple departments including operations, project management, project controls, commercial, finance, legal, insurance, client representatives and members of our joint venture partners.
What You'll Do Here
- Develop the Prime Contract Commercial Management Plan, identifying appropriate change / claim management processes, resource needs, templates and deliverables
- Work closely with the procurement manager and subcontracts manager to ensure flow down of the prime contract terms to other related contracts on the project
- Manage the commercial aspects of the prime contract including change management, payment, reporting and dispute resolution
- Manage applications for payment process under the contract
- Work closely with the Project Director or Project Manager throughout the construction of the project and act as an advisor in mitigating any risks that may arise along with recommending appropriate solutions;
- Assist the project team with contract requirements including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract
- Advise on opportunities for revenue savings, risk mitigation and claim avoidance
- Provide interpretation of Prime Contract language to support other departments
- Train project staff on contractual requirements / obligations
- Train project staff on implementation of contract processes and procedures
- Work closely with engineering, construction, procurement and project controls to understand project activities and any impact of those activities to the prime contract
- Review cost and schedule variances to understand whether issues need to be notified to the Owner and adjustments made for time and cost under the contract
- Work with Project Management Team to develop and ensure appropriate correspondence with the Client is issued to protect the Company's interests
- Track contract changes/modifications and ensure appropriate documentation / records are being kept to support such issues
- Preparation of narratives and entitlement documentation
- Identification and implementation of records keeping to validate potential changes
- Prepare any change orders, variations, claims, counter claims, delay claims to the contract and assist with negotiation / resolution
- Quantify the additional time and compensation associated with any changes by the client
- Manage the dispute process of any issues under the Prime Contract
- Develop process to identify, prepare and manage claims as they develop and work with the Commercial Manager, Project Manager and/or Project Director to negotiate any claims
- Coordinate close out processes relating to the Prime Contract
- Consultation with Legal and Project / Project Management team / Subject Matter Experts / External Consultants as appropriate
- Work with the Risk Management and Insurance teams on any issues that may be related to insurance policies
- Ensure timely and accurate contractual correspondence
- Maintain excellent relationships with the owner, client, project team, subcontractors and the community
What You Bring To The Team
- Minimum undergraduate degree in a related discipline such as engineering
- Experience in a leadership / management capacity
- A minimum of 10 years of experience in contract management, project management, claims management, bid management, project controls and/ or contract law
- Minimum of 5 years' experience in managing Prime Contracts including change management and dispute resolution on major construction projects
