Counsel Litigation

As CPSA's **Litigation and Hearings Counsel**, you will facilitate the provision of high-quality legal advice, dismiss oversight, and litigation services. Specifically, you will be responsible for researching, preparing, negotiating, overseeing and executing the preparation of documents, witnesses, and representation in legal proceedings of courts, administrative tribunals and appeal bodies.
**KEY RESPONSIBILITIES**:
- Acts as lead counsel in litigations on behalf of the Complaints Director.
- Provides legal opinion and advice to the Complaints Director, Director of Professional Conduct and Associate Complaints Directors on matters pertaining to professional regulation and discipline.
- Ensures the department and the Complaints Director is compliant with all requirements under the common law and legislation.
- Makes recommendations and develops legal strategies for the handling of litigation files/portfolio, in alignment with internal and external drivers.
- Monitors and liaises with external legal counsel for matters pertaining to Professional Conduct’s administrative tribunals, court actions, and appeals.
- Drafts and reviews documentation to support litigation; prepares witnesses and conducts case evaluations and assessments related to all matters being directed to hearing.
- Provides day-to-day guidance, feedback and education to other staff in support of departmental objectives and development.
- Supports professional conduct in policy/process development.
- Anticipates and mitigates potential legal liability within Professional Conduct and develops strategies to avoid legal risk.
- Makes recommendations and support continuous improvement of litigation management and technology systems, processes, systems and tools.
- Participation in co-developing and maintaining a CPSA community of practice for legal professionals.
- Other duties as required.
**QUALIFICAITONS**:
**Education**:
- Undergraduate degree along with a Bachelor of Laws (LL.B.) or Juris Doctor (J.D.) from a recognized Law School.
- A member in good standing with the Law Society of Alberta.
**Experience**:
- 5-10 years of professional regulatory (health or other regulatory bodies) litigation or advocacy experience at a law firm or comparable in-house experience.
**Skills**:
- Knowledge in civil and quasi-judicial/administrative law litigation.
- Extensive knowledge of court and tribunal procedures and processes.
- Knowledge of relevant legislation and common law.
- Effective judgment and decision-making skills.
- Effective negotiation and consensus building skills.
- Effective analytical and problem-solving skills.
- Exceptional attention to detail and time management.
- Strong communication skills.
- Strong interpersonal skills with a demonstrated ability to collaborate with a multidiscipline team and other colleagues.
- Experience with medical terminology/medical regulation would be an asset.
