- Conducts Provincial Offences Act prosecutions and appeals for offences under applicable statutes and bylaws.
**Duties/Responsibilities**
- Conducts prosecutions under Provincial/Federal statutes and municipal bylaws in Provincial Courts. Evaluates charges; reviews admissibility of evidence; researches and analyses issues; determines courses of action; researches and prepares case law responses; conducts disclosures, motions, and pre-trial proceedings; reviews witness statements; interviews and prepares witnesses; and prepares/directs the preparation and serving of Court documents. Orders interpreters. Negotiates settlements.
- Appears as respondent or appellant/applicant in higher Courts on matters relating to appeals.
- Advises legal professionals, Ministry officials, the public, coroners, Justices of the Peace, and Regional staff on the Provincial Offences Act, rules of Court, and legislation.
- Conducts research for the Manager. Assists to gather evidence in assigned cases.
- Participates on project teams and ad hoc meeting groups to provide legal input.
- Provides legal advice and exchanges information with Regional/Provincial Police, Crown Attorney's Office, judges, Justices of the Peace, lawyers, and other government agencies. Contacts expert witnesses to review evidence.
- Provides training to police and by-law enforcement officers regarding the collection, disclosure, and discovery of evidence in Court, provincial offenses act investigations, and prosecutions.
- Backs up the Manager as required.
- Performs related duties as required.
**Knowledge, Skills, and Abilities**
- Knowledge and skill are normally acquired through degree/diploma in a related field (e.g., paralegal/court and tribunal agent), plus related prosecution experience.
- Must be licensed by the Law Society of Ontario as a Lawyer or Paralegal at time of hire.
- Knowledge of the Provincial Offences Act, Highway Traffic Act, legal practices and procedures, investigation techniques of enforcement agencies, court procedures, theory and practice of advocacy, rules of evidence, Canadian Constitution, Charter of Rights and Freedoms, related statutes and regulations, and relevant case law.
- Knowledge of and ability to comply with policies and procedures.
- Analytical, organizational, problem solving, and continuous improvement skills to conduct research including statutory interpretation; analyze issues/legal documents; and determine appropriate courses of action.
- Human relations, negotiation, persuasion, and communication skills to present legal arguments; negotiate settlements; represent the program on committees; present/explain complex or politically sensitive issues to senior management, staff, agencies, the public, and the media; present case, examination, and cross-examination of witnesses, and legal arguments; and participate as an effective team member.
- Ability to read and interpret legal documents. Ability to write legal opinions, reports, correspondence, and pleadings, involving precise use of specialized language.
- Computer skills using software such as Microsoft Office, file management (CAMS) and the integrated criminal offences network (ICON).
- Ability to travel within and outside Waterloo Region. Ability to support and demonstrate the Region’s values.
