**About the College of Immigration and Citizenship Consultants (the College)**

The College is the authority mandated by the Government of Canada to regulate the practice of Regulated Canadian Immigration Consultants (RCICs) and Regulated International Student Immigration Advisors (RISIAs). Its role, authority and powers are established in the _College of Immigration and Citizenship Consultants Act _(Canada). **How will this role support our team?**

The Associate Counsel executes the College’s disciplinary, fitness to practise, and registrar appeal processes by supporting the Lead Counsel and Counsels during all stages of discipline proceedings (including prehearing conferences, disclosure exchanges, motions, and hearings). The incumbent also independently manages a portfolio of less complicated disciplinary and fitness to practise cases.

**Responsibilities Include (but are not limited to)**
- Independently maintain a caseload of discipline, fitness to practise, and registrar appeal matters before the Tribunal.
- Prepare for written and oral proceedings. Review evidence, prepare witnesses and obtain or conduct legal research.
- Conduct settlement discussions with licensees and/or their counsel.
- Draft, review and prepare legal documents and opinions.
- Attend case conferences, motions, and Tribunal hearings.
- Support the Lead Counsel and Counsels with the management of their cases (e.g. review evidence, conduct research, etc.). Provide input into the prioritization, strategy, and management of litigation matters.
- Assist with Federal Court Judicial Reviews.
- In consultation with the Lead Counsel and Counsels, liaise with external counsel to provide direction/instructions on cases they are managing for the College.
- Identify policies and practices related to professional conduct that need to be developed or updated based on legal issues encountered (e.g. issues related to the investigative process) and advise the Lead Counsel and Counsels about them.

**This role will support our team by providing**
- Analytical, critical thinking and problem-solving skills to conduct legal research, work out complex legal issues, and support the litigation of cases
- Time management, organizational and decision-making skills to manage and prioritize competing priorities and deadlines
- Flexibility to work in a fast-paced changing environment as a collaborative team player who demonstrates initiative
- Interpersonal, stakeholder relationship management and advocacy skills to represent the College before the Tribunal and Courts
- Negotiation and conflict resolution skills to negotiate settlements for disciplinary matters
- Written and verbal communication skills to prepare detailed reports and/or briefings for internal and external stakeholders and communicate effectively
- Tact and discretion to work on confidential and sensitive matters

**Required Education and Experience**
- Law Degree (LL.B. or JD) and a licence to practise in a Canadian province
- 1-3 years of litigation/prosecution experience gained through private legal practice or in a regulatory environment
- Knowledge of prosecutorial standards and practice, professional regulation and administrative law and the ability to acquire knowledge of the College Act, regulations, By-laws, Code of Professional Conduct and Tribunal Committee Rules of Procedure
- Knowledge of the Federal Courts Act and Federal Court Rules
- Knowledge of office/administrative software
