Job Summary:
The Data Privacy Counsel will be a key member of the Global Data Privacy Team at Milliman, responsible for implementing the company's privacy program in the USA and Canada. This role requires a strong understanding of US federal and state data privacy laws, including HIPAA/HITECH, GLBA, and FCRA, as well as international data privacy laws, particularly GDPR.
Key Responsibilities:
- Conduct research and monitor new and revised federal and state privacy laws, providing regular updates to the Global Data Privacy Director.
- Provide legal advice on a day-to-day basis, assisting with the implementation of Milliman's Global Data Protection Policy in the USA/Canada.
- Prepare and present data privacy trainings to Milliman's U.S./Canadian practices, ensuring compliance with relevant laws and regulations.
- Negotiate U.S. Data Sharing Agreements and collaborate with Milliman's U.S. Legal Team, identifying and mitigating privacy risks in processes and systems.
- Assist with the creation of ad hoc Data Sharing Agreement templates, responding to requests for data privacy advice from the business, and maintaining a network of local DPCPs (Data Privacy Contact Persons).
- Monitor implementation of data privacy recommendations made under Privacy Impact Assessments, maintaining Milliman's Records of Processing Activities and reviewing Data Mapping Questionnaires annually.
- Assist with the management of Data Subject Access Requests (DSARs) and other requests from data subjects residing in the USA, drafting Data Protection Impact Assessments where required.
Requirements:
- A Juris Doctor or qualified lawyer in a relevant jurisdiction, with a minimum of 6 years of post-admission experience working in data privacy law.
- Working knowledge of US federal and state data privacy laws, including HIPAA/HITECH, GLBA, and FCRA, as well as international data privacy laws, particularly GDPR.
- Strong contract drafting and negotiating experience, with excellent organization and planning skills, and the ability to adapt to different cultures and mentalities.
- Demonstrated experience in giving trainings, with excellent written and communication skills, and exceptional interpersonal skills.
- CIPP certification through the IAPP (CIPP/US) is a plus.
