SUMMARY OF RESPONSIBILITIES

Reporting to the Supervisor of Operations and Enforcement within the Licensing division, this role emphasizes the investigation and enforcement of business licensing regulations for physical establishments. The officer will analyze, interpret, and ensure adherence to various by-laws, including those related to zoning, signage, property standards, lotteries, and yard maintenance. The position involves addressing inquiries and complaints, advocating for compliance with the Licensing By-law, and serving as a representative for businesses under the Open for Business initiative.

KEY FUNCTIONS

The Licensing Compliance Officer is tasked with investigating, enforcing, and ensuring compliance with regulations concerning licensing, signage, lotteries, zoning, property standards, and yard maintenance. This includes oversight of business establishment licensing, residential care facilities, payday loan operations, lodging houses, public garages, personal wellness services, and other relevant sections of the applicable by-laws. The officer will also assist colleagues in the Licensing section as necessary.

The officer will engage with applicants, customers, licensees, and property owners through various communication channels, providing guidance and education to facilitate compliance.

Responsibilities include:

  • Proactively investigating potential violations of licensing, permits, and zoning regulations to enforce compliance.
  • Contributing to sectional objectives by providing relevant information and data.
  • Adhering to the Progressive Enforcement Policy to achieve compliance.
  • Applying policies and procedures to interpret by-laws effectively.
  • Taking appropriate actions based on investigations, including issuing orders, administrative penalties, tickets, and preparing for legal proceedings.
  • Making recommendations for management approval regarding enforcement actions.
  • Acting as an ambassador for the Licensing section, assisting new or unlicensed businesses through the licensing process.
  • Preparing written and verbal reports and correspondence.
  • Collaborating with other regulatory agencies to resolve issues and clarify enforcement policies.
  • Maintaining accurate records of investigations and inspections.
  • Gathering and presenting evidence in court and related tribunals.
  • Following up on expired licenses and permits to ensure compliance.
  • Providing feedback on by-law amendments and policy changes.
  • Utilizing equipment such as radios, computers, and measuring tools for inspections.
  • Driving to various locations for investigations and inspections.
  • Complying with health and safety regulations and departmental policies.
  • Performing additional duties as assigned.

REQUIRED QUALIFICATIONS

  • Previous experience in law enforcement or relevant educational background in Law and Security Administration or Police Foundations.
  • Completion of the Ontario Property Standards Association Basic Course (Level I) is preferred, with the ability to complete further training within specified timeframes.
  • Successful completion of the Municipal Law Enforcement Officer's Association's courses is advantageous.
  • Strong ability to interpret and apply by-laws and legislation.
  • Proven problem-solving skills with a focus on customer service.
  • Effective communication skills, both verbal and written, with various stakeholders.
  • Ability to perform confidently under pressure, including in legal settings.
  • Experience in conducting investigations and preparing related documentation.
  • Proficiency in computer applications, including Microsoft Office, and familiarity with database management software is an asset.
  • Training in dispute resolution or mediation is considered beneficial.

ADDITIONAL NOTES

A valid Class 'G' Driver's License and a clean driving record are required. Candidates must also pass a Criminal Reference Check or Vulnerable Sector Screening prior to employment. The role requires flexibility to work various shifts, including weekends and holidays, and adherence to health and safety policies is mandatory.
