Position Overview
The role involves managing prosecutions under the Provincial Offences Act and handling appeals related to various statutes and bylaws.
Key Responsibilities:
- Conduct prosecutions in Provincial Courts under Provincial/Federal statutes and municipal bylaws. Evaluate charges, assess evidence admissibility, research legal issues, and prepare case law responses. Manage disclosures, motions, and pre-trial processes; review witness statements; interview and prepare witnesses; and oversee the preparation and serving of Court documents. Coordinate interpreter services and negotiate settlements.
- Represent as a respondent or appellant/applicant in higher Courts concerning appeals.
- Provide legal guidance to legal professionals, Ministry officials, the public, coroners, Justices of the Peace, and Regional staff regarding the Provincial Offences Act, Court rules, and relevant legislation.
- Assist the Manager with research and evidence gathering for assigned cases.
- Participate in project teams and ad hoc groups to offer legal insights.
- Deliver legal advice and collaborate with Regional/Provincial Police, Crown Attorney's Office, judges, Justices of the Peace, attorneys, and other governmental bodies. Engage expert witnesses for evidence review.
- Train police and by-law enforcement personnel on evidence collection, disclosure, and discovery processes in Court, as well as Provincial Offences Act investigations and prosecutions.
- Support the Manager as needed.
- Perform related duties as necessary.
Qualifications:
- Comprehensive knowledge of the Provincial Offences Act, Highway Traffic Act, legal practices, enforcement investigation techniques, Court procedures, advocacy theory and practice, rules of evidence, the Canadian Constitution, the Charter of Rights and Freedoms, and pertinent statutes and regulations, typically acquired through a college diploma in a related field (e.g., law enforcement, paralegal) along with relevant prosecution experience.
- Understanding of and ability to adhere to policies, procedures, and applicable legislation.
- Strong analytical, organizational, problem-solving, and continuous improvement skills for conducting research, interpreting statutes, analyzing legal documents, and determining appropriate actions.
- Excellent human relations, negotiation, persuasion, and communication skills for presenting legal arguments, negotiating settlements, representing the program on committees, and explaining complex or sensitive issues to senior management, staff, agencies, the public, and the media.
- Proficient in reading and interpreting legal documents, as well as drafting legal opinions, reports, correspondence, and pleadings with precise use of specialized language.
- Competent in using software such as Microsoft Office and the integrated criminal offences network (ICON).
- Willingness to travel within and outside the Region.
- Ability to uphold and demonstrate the Region's values.
