Reporting to the Town Solicitor, the Town Prosecutor is responsible for all matters in connection with the prosecution of charges under provincial legislation (e.g. Building Code Act, Fire Protection and Prevention Act) and Town of Oakville by-laws commenced under the Provincial Offences Act in the Ontario Court of Justice. The Town Prosecutor oversees and acts as a screening officer for the review of administrative penalties for parking, licensing, and other by-law violations pursuant to the provisions and regulations of the Municipal Act, 2001, and participates in reviews by a hearing officer of screening officer decisions.

**What can I expect to do in this role?**:
The Town Prosecutor is responsible for the prosecution of Oakville municipal by-law offences as well as offences under provincial legislation. The Town Prosecutor also oversees the delivery of screening services and serves as a screening officer in the review of administrative penalties, and participates in reviews of screening officer decisions before a hearing officer. The duties and responsibilities of the Town Prosecutor include:

- Providing assessment of evidence and charges laid by Town enforcement staff, ensuring prosecutions have a reasonable prospect of conviction, and are proceeding in the public interest.
- Responding to inquiries and liaising with enforcement and other Town staff, defence agents, counsel, court service staff, defendants, civilian witnesses, and various members of the public.
- Providing disclosure to defendants, and participating in judicial pre-trials and plea negotiations and resolution of charges.
- Representing the Town at the Ontario Court of Justice, ensuring timely prosecution of offences to avoid dismissal for delay, preparing enforcement staff and witnesses for trial, responding to motions, conducting trials and hearings, and providing written and oral submissions.
- Seeking to ensure convictions and fines maintain adequate deterrents, and addressing prosecution outcomes with defence lawyers, paralegals, and defendants.
- Independently managing and measuring a significant case load.
- Maintaining information, records, and statistics relating to prosecution activities and providing written reports of court outcomes.
- Engaging members of the public in the review of administrative penalties as a screening officer and participating in the review of screening officer decisions before a hearing officer under the Town’s administrative penalties process.
- Overseeing the administration and delivery of Town of Oakville screening services
- Providing periodic training to enforcement staff in investigative and enforcement best practices, note taking, rules of evidence, trial preparation, and providing evidence as witnesses.

**How do I qualify?**:

- At least three (3) years of relevant experience in a court or tribunal setting.
- Experience in a law enforcement and legal environment.
- Working knowledge of the Courts of Justice and Provincial Offences Act, as well as rules of evidence.
- Knowledge of the Memorandum of Understanding and Local Side Agreement.
- Knowledge of municipal administrative penalties processes.
- Proven ability to deal tactfully, effectively and inclusively with the judiciary, legal profession, and members of the public.
- Outstanding interpersonal skills, the ability to influence and effectively communicate with all stakeholders.
- Advanced critical and strategic analytical skills with demonstrated ability to provide sound advice and direction to enforcement staff, external agencies, and other interested parties.
- Excellent problem solving and negotiation skills, with experience in conflict resolution.
- Exceptional organizational, administrative, priority setting, and time management skills.
