- The decolonization of law requires engagement with indigenous legal
- orders. However, the more we learn, the more we discover the tension
- between them and the settler/Canadian legal system. These two kinds of legal systems are not only different, but also are often contradictory in their deepest commitments and values, underlying structures, and the legal principles that arise therefrom. From this position, it follows that bringing indigenous law into the settler legal system is not a project of decolonization. What use, then, can meaningfully be made of indigenous legal orders in a settler legal practice? This course confronts that question directly. Beginning with a historic overview of how Indigenous law has been engaged by judges in Canadian legal decisions, it will engage legal ethics, professional responsibility and the experience of practitioners to provide an answer to the use of indigenous law in a settler legal practice.- TQR: At a minimum, a first degree in law. Several years of significant practice or professional experience, in the relevant area; Experience in teaching undergraduate law students in a bilingual settingDisclaimer:
- Please note that given the resumption of in-person teaching activities, most courses will be taught in person. Exams may however need to be administered remotely depending, mainly on the size of the class. Course Lecturers will be required to plan accordingly. Should government restrictions prohibit the resumption of in-person teaching, courses will revert to remote teaching.In the event of such a change, Course Lecturers will be advised without delay. Course Lecturers may be required to prepare and deliver teaching material suited to a remote/online teaching environment using a virtual learning platform [e.g., Zoom, WebEx] and the McGill myCourses learning management system. Training and assistance on remote teaching is available through Teaching and Learning Services (TLS). Course Lecturers are encouraged to record their lectures.The University may, at its discretion, assign the person of choice to give this Course/Teaching.-
