Position Commercial Director Department Endless Surf (ES) Reports To President, Endless Surf Purpose The Commercial Director with Endless Surf is responsible for the full cycle contract process for the sale, construction, and commissioning of Endless Surf products. This includes the pre‑contract phase, bidding, contract drafting, and post‑contract execution, supporting installation activities for large contracts, and ensuring compliance with local contracting processes. Key Responsibilities – What You’ll Be Up To Documentation Own the full contracting process and maintain Endless Surf contract templates. Ensure commercial terms, risks, and knowledge are communicated to the Chief Commercial Officer and Business Development team. Work with the Director of Operations to deliver products in line with contract terms. Collaborate with the Chief Technology Officer to align product delivery with contractual terms. Partner with WhiteWater shared services teams, including Legal and Risk Management, ensuring compliance with company guidelines. Pre‑Contract Responsibilities Guide contracting process with potential customers to maximise commercial position. Help clients understand contractual terms, obligations, and services to be received. Assemble and update contractual documentation, annexes related to specification, scope, and schedule. Work with Director of Legal and Risk Management to adhere to company guidelines. Manage external legal relationships, budget matters, intellectual property, liabilities, etc. Liaise with Operations for final arbitrage. Deliver improvements to overall process as needed. Post‑Contract Responsibilities Lead commercial planning and execution across all Endless Surf pool construction projects. Sign off on commercial planning and execution in compliance with executed contracts. Ensure compliance with legal standards and industry regulations. Support schedule of values and improve the LC process. Collaborate with Operations, site teams, and external third parties to monitor progress and resolve issues promptly. Produce detailed financial reports for senior leaders and stakeholders. Participate in meetings and drive improvements where necessary. Qualifications and Experience – Hard Skills You Bring Experience with all aspects of contracts, subcontracts, standard and non‑standard terms. Bachelor's Degree in Engineering, Business Administration, Law, or related field. Minimum of 10 years of project delivery, construction, business, risk, and contracting experience. Exceptional interpersonal skills and ability to maintain relationships at all levels. Comfortable in fast‑paced and dynamic environment. Energetic, self‑starter with entrepreneurial spirit.
