Job Purpose: ELNA Medical is committed to protecting the privacy of patients’ personal health information and promoting a culture of privacy and confidentiality. ELNA Medical Group is seeking an experienced Policy and Organizational Compliance Advisor to lead ELNA's efforts in safeguarding sensitive data and adhering to all applicable privacy laws and regulations, both domestically and internationally.

The Advisor assists the Privacy Officer with the implementation, monitoring and auditing of the privacy program in a complex, national healthcare ecosystem, promoting privacy practices and standards and providing formal and informal analysis and guidance.

The Advisor must be able to confidently provide guidance based on law, best practice, and working knowledge of business requirements. The Advisor must have sufficient technical knowledge and comprehension of analytical tools to identify risks and gaps as new information is presented. The Advisor must be able to effectively communicate requirements and gaps to the Privacy Officer and relevant stakeholders.

Principal Responsibilities:

Privacy Program Leadership

  1. Oversee ELNA's privacy program, ensuring alignment with evolving legal and regulatory requirements
  2. Develop and implement privacy policies and procedures that adhere to applicable laws and standards
  3. Conduct Privacy Impact Assessments (PIAs) to identify and mitigate potential privacy risks
  4. Collaborate with cross-functional teams (operational, HR, IT, security) to embed Privacy by Design principles
  5. Utilize data mapping and discovery tools to identify and classify personal information within the organization's systems

Compliance & Risk Management

  1. Identify, develop, and implement business policies and processes that maintain or improve enterprise privacy compliance
  2. Review and update existing documentation of IT controls, business processes, policies, and procedures
  3. Monitor compliance with privacy and security laws and regulations, conducting regular audits and assessments
  4. Investigate and respond to privacy complaints, confidentiality incidents, and data subject access rights requests, ensuring timely resolution and reporting
  5. Participate in the due diligence process for potential acquisitions, providing a company risk assessment
  6. Collaborate with the security team to ensure alignment between privacy and security initiatives
  7. Develop and maintain data processing agreements and other privacy-related contracts with third-party vendors and partners

Training & Awareness

  1. Oversee privacy and security training and awareness programs for employees and stakeholders
  2. Maintain the Learning Management System (LMS) with relevant training material and audit employee annual compliance
  3. Develop engaging and informative privacy awareness materials and campaigns for employees and patients

Collaboration & Communication

  1. Serve as the primary point of contact for privacy-related inquiries
  2. Proactively monitor and analyze emerging privacy trends, technologies, and best practices
  3. Provide strategic advice and guidance to senior management on privacy matters
  4. Respond to requests for information pertaining to privacy
  5. Assist IT Team in achieving security goals and standards (ISO 27001, SOC II, NIST)
The Ideal Candidate will possess:

Education and Experience

  1. Bachelor's Degree in Business, IT, or a related field, or a combination of education and equivalent work experience is an asset
  2. Law Degree (J.D. or LL.B.) is an asset
  3. 5+ years of experience in policy development, privacy law, regulatory compliance, or a related field

Privacy and Healthcare Law Expertise

  1. Expert knowledge of Canadian privacy laws (PIPEDA, provincial laws like PHIPA, HIA, Law 25, Law 5) and healthcare privacy regulations
  2. Understanding of US (HIPAA, CCPA, etc.), EU (GDPR), and UK (DPA) privacy laws and regulations is an asset

Technical Skills & Certifications

  1. Asset: Industry standard certifications (CIPM, CIPP/C, CHPS, CISSP, CISM, CISA, ISO 27001 Lead Implementer/Auditor, PMI)
  2. Experience with NIST, ISO 27001, SOCII Type 2, and GDPR frameworks
  3. Foundational knowledge of information security principles and common risks
  4. Proficiency with data mapping and discovery tools

Communication & Interpersonal Skills

  1. Excellent communication, negotiation, and problem-solving skills
  2. Ability to explain complex technical topics to various stakeholders with varying levels of understanding
  3. Strong interpersonal skills and the ability to build relationships with diverse stakeholders
  4. Fluency in both English and French (written and verbal) required

Context and Environment:

Must be able to work in a fast-paced, high pressure and complex technical environment that requires attention to detail. The ability to sit at a computer and view a computer monitor for an extended period. May be required to work unconventional hours, weekends, holidays, late nights, or early mornings occasionally. Able to employ professionalism, patience, and self-control in high-stress situations. Must be able to pass both internal and government mandated security screenings.
