Project Overview

Bechtel Infrastructure, along with key sub-vendors Bantrel and Comtech, has been appointed as the Delivery Partner (DP) within an Integrated Project Team (IPT) comprising the customer, Metrolinx, and its Technical Authority (TA) for the Ontario Line Subway (OLS) Project. The OLS Project scope includes the design build, operation, and maintenance of all infrastructure and rail systems associated with 15 stations and over 15km of new alignment, being delivered through major Public Private Partnership (P3) contracts and multiple Early and Advanced Works (EAW) contracts. The OLS Project is planned to open for revenue service in 2031. DP forms a key part of the overall leadership of the OLS Project.

 

Position Summary

The Claims Support Director will be responsible to develop and implement a project claims management program for the OLS Project, to facilitate effective administration of contract disputes and claims as may arise on various packages for the OLS Project. Duties and responsibilities include: leading evaluation of received disputes and claims to determine entitlement, formulating strategies in consultation with relevant project stakeholders and Legal on recommended disposition, providing proactive engagement and direction to project team members to enable alignment on strategy/recommendations, and implementing the necessary policies, processes and procedures for effective dispute and claims management with the help of subordinate managers.

 

Responsibilities

  • Working on dispute resolution, mediation assistance, claims defense and high-level claim report writing on behalf of Metrolinx.
  • Under limited supervision, using independent judgment, manage claims and disputes from Vendors in accordance with the Contractual Agreement and all Metrolinx standards.
  • Provide subject matter expertise in all aspects of claims management.
  • Manage and maintain comprehensive claims documentation within the contracts administration software, including early warning notifications.
  • Lead all dispute and claims management activities with respect to Metrolinx, Project Cos and third-party claims.
  • Investigate, evaluate, and provide recommendations for the settlement of claims.
  • Provide detailed evaluation of potential claim impact to the Project Management team.
  • Provide summary reports to executive management.
  • Liaison with client legal team on an as needed basis use alternative dispute resolution technique.
  • Effectively and positively influence stakeholders to comply with claims process as set out in the relevant project agreement(s).
  • Responsible for the development and management of a procedure to recognize and identify contract claims as they develop and manage the timely resolution under the changes provisions wherever possible, obtaining claims and legal expertise as appropriate.

 

Qualifications and Skills

Basic Qualifications

  • Minimum fifteen (15) years relevant experience, with at least ten (10) years’ prior experience in Public Private Partnership (P3) and/or Design Bid Build (DBB) projects preferred.
  • Degree in construction management, engineering, project management, or equivalent. 

Additional Qualifications 

  • Experience in delivering claims management services on large infrastructure projects.
  • Strong knowledge of contract laws.
  • Experience of working with delay claims, productivity claims, acceleration and extensions of time.
  • Experience in arbitration and dispute resolution services.
  • Be commercial astute, responsive and act quickly under changing circumstances.
  • Highly organized and ability to process and efficiently manage numerous claims.
  • Experience in contract administration and management software (e.g. Primavera Unifier, CM14).
  • Comprehensive knowledge of commercial/business management functions with work experience of a progressively responsible nature.  
  • Responsible for managing several business functions on medium to large projects of moderate complexity. 
  • Exercises autonomy in decisions with a mid to long term impact on the project.
