If you reflect these values, have the knowledge, skills, and abilities to make a difference through your work, and are passionate about acting in the best interest of public safety – then come be a part of our diverse and inclusive team Position Summary Reporting to the Deputy Registrar & Chief Regulatory Officer (CRO), the Director, Conduct & Legislation is a key contributor to the work of the Regulatory Division and is responsible for the strategic leadership, direction, and day-to-day operation of APEGA’s professional conduct system (investigations, discipline, and appeals groups), and the unlicensed practice group. The position oversees regulatory policy development and projects and provides expert interpretation of legislation and of regulatory processes and policies. It plays a key leadership role in supporting the CRO in any regulatory changes and is responsible for regulatory review to best practices and training of regulatory staff and volunteers. Responsibilities Coordinating activities across and on behalf of the regulatory division as directed by the CRO. While not in a direct supervisory relationship with all regulatory directors, the Director, Conduct & Legislation acts as a conduit for coordination of regulatory activities that cross departmental and divisional boundaries and as a nexus of information and data concerning all regulatory operations as directed by the CRO. The Director, Conduct & Legislation is to foster a positive working environment that supports communication, collaboration, and high performance as well as staff engagement, satisfaction, and professional development. Providing high-level decision-making and interpretation of legislation and policy in complex cases or situations. This includes developing criteria and refining the intent of the act within the regulatory and political environment. Providing advisory services and troubleshooting issues related the Regulatory Division both internal and external to the organization, including aiding or troubleshooting issues for the CRO and other Directors and working collaboratively with other regulators on issues impacting APEGA and the profession. Facilitating both internal and external discussions, identifying issues, and helping all sides find common ground while keeping lines of communication and dialogue open. Coordinating legal activities not directly tied to a statutory function involving independent counsel including non-statutory court actions, privacy queries, and complaints against regulatory staff. Providing regulatory advice and guidance to the Chief Regulatory Officer, Regulatory Directors, internal and external stakeholders and regulatory review process training for regulatory staff and volunteers. Overseeing operational planning and implementation including financial and human resource leadership and direction, and program execution in managing regulatory reviews and regulatory division volunteer and staff training. Providing advisory services and troubleshooting issues related to the regulatory division both internal and external to the organization. This includes providing assistance or troubleshooting issues for the CRO and other Directors and working collaboratively with other regulators on issues impacting APEGA and the profession. Providing senior leadership to the professional conduct groups through effective program and project planning and execution, financial and human resource oversight and direction, policy development and interpretation, and issues management. Overseeing the Investigative Committee, Discipline Committee and Appeal Board to ensure leveling and standards application and consistency in the decision-making process and requirements set out by the EGPA/PGA. This includes ensuring good policy, good methodology, execution, and fair and timely due process. Overseeing the professional conduct functions and processes required of a self-regulating professional body, ensuring transparency and the principles of natural justice are respected and reflected throughout. Acting as a subject matter expert (SME) for the professional conduct system to interpret statutes, policies, and processes as they relate to these functions with the ultimate responsibility for identifying issues and ensuring credible and defensible processes or policies are created or maintained and issues are resolved or mitigated. Providing senior leadership to the unlicensed practice group through effective program and project planning and execution, financial and human resource oversight and direction, policy development and interpretation, and issues management. Administrative law, and the principles of fairness and natural justice Knowledge of how governance boards and committees work and are structured. In-depth knowledge of project management approaches, tools, and phases of a project lifecycle. Superior communication skills both verbal and written. Superior analytical and conflict resolution skills to break down complex regulatory issues and influence the various stakeholders on a course of action that identifies common ground, is rational and in keeping with the intent of the legislation. Strategic and business planning and organizational skills. Ability to set direction/objectives and align individual/departmental objectives with the organization and influence external organizations with APEGA’s objectives. Superior ability to problem-solve in situations involving diverse and conflicting data sets surrounded by political or other considerations and to provide projection of future/strategic impacts and mitigation. Leadership and human relation skills in leading and developing teams of professionals across diverse functional areas including technical specialists, senior and executive management, boards and committees and other provincial bodies. Effectively communicate the mission and vision of the association, serve as a role model and create and foster a culture of integrity throughout the association. Ability to build relationships, lead and influence broad groups of stakeholders – some without positional leadership to achieve objectives. Ability to empathize with broad/diverse groups of stakeholders. Qualifications Registrant of a self-regulating profession, such as -- Professional Engineer or Geoscientist registered with APEGA or eligible for membership in APEGA. -- Lawyer registered with the Law Society of Alberta, or eligible for membership of the same 10 years of progressively responsible senior management roles Preference will be given to candidates who have led technical engineering teams or teams involved in regulatory programs. Experience must include significant committee or board work providing advice and support in the development of good regulatory processes, practices, and policy. Additional experience in providing operational oversight of complex programs including policy and program development and resource management in a regulated or quasi-judicial environment is required. Experience with the operation of statutory committees and boards including governance, volunteer management, effective decision making. Experience with the conduct of quasi-judicial decision-making bodies. Equivalencies may be considered.
