The Claims Manager oversees all accident investigation and claims management for Canadian and US trucking and logistics operations. This role handles the complete claims lifecycle from incident response through settlement, ensuring compliance with federal, state, and provincial regulations across both countries. A legal background is highly valued given the complex cross-border regulatory environment and litigation management requirements.
Qualifications{{{{:}}}}
- Provide immediate response to accidents across North American operations and coordinate comprehensive investigations including scene documentation, evidence preservation, and witness statements
- Review accident reports, driver logs, ELD data, vehicle maintenance records, and dispatch documentation to determine fault and liability
- Coordinate with police, regulatory authorities, and accident reconstruction experts in both countries
- Ensure compliance with mandatory accident reporting under FMCSA regulations, provincial highway traffic acts, state requirements, and federal Motor Vehicle Safety Act
- Manage all claims including automobile liability, bodily injury, property damage, cargo loss, and third-party claims across US states and Canadian provinces
- Establish appropriate reserves based on exposure assessment and varying tort environments in different jurisdictions
- Negotiate settlements with claimants, attorneys, and insurance adjusters in both countries
- Manage claims through litigation including coordination with defense counsel, discovery/examinations for discovery, depositions, mediations, and trial preparation
- Coordinate with legal counsel across multiple US states and Canadian provinces
- Manage cross-border claims involving accidents or cargo damage in both countries
- Develop and maintain relationships with insurance carriers, brokers, legal counsel, and independent adjusters across North America
- Manage third-party administrators, medical providers, repair facilities, and expert witnesses in both countries
- Develop and implement claims handling procedures compliant with US federal/state and Canadian federal/provincial requirements
- Train staff on accident response and claims reporting procedures for cross-border operations
- Address jurisdictional issues in cross-border accidents and cargo claims
- Monitor claims expenses and manage claims budget
- Support insurance renewal process with loss analysis from both countries
- Analyze loss trends across North American operations to inform risk management strategies
Requirements
- Bachelor's degree in Business, Risk Management, Insurance, or related field
- Minimum 5-7 years of claims management experience in North America
- At least 3 years in transportation, trucking, fleet, or commercial auto claims
- Proven experience managing complex bodily injury and property damage claims in multiple jurisdictions
- Experience with accident investigation and litigation management in US and/or Canada
- Knowledge of FMCSA regulations, DOT compliance, and cross-border transportation issues
- Understanding of insurance regulations and tort systems in both countries
- Experience managing cross-border claims and understanding jurisdictional issues
- Knowledge of Hours of Service regulations in both countries
- Expert negotiation, analytical, and investigative skills
- Ability to interpret insurance policies, contracts, and legal documents from both countries
- Proficiency with claims management software, TMS systems, and Microsoft Office Suite
