How you will contribute as part of the TRCA team:
The Senior Manager, Enforcement and Compliance, is responsible for leading a team of enforcement officers focused on TRCA's legislatively mandated enforcement and compliance program. The position develops and evolves strategic and operational enforcement and compliance planning across TRCA's jurisdiction and represents TRCA in Ontario Courts negotiated settlement agreements and relevant regulatory committees and partnerships. The Senior Manager oversees and manages the Provincial Offences program on behalf of TRCA.
Major Responsibilities:
- Develops, refines and administers operational business planning, seeking to continually improve business operations, while providing direction for organization wide strategic planning as it relates to enforcement and compliance.
- Provides expert advice, technical direction, and recommendations to Senior Leadership Team (SLT) through innovative and efficient processes to ensure TRCA's corporate enforcement and compliance requirements are administered.
- Directs and guides TRCA as it relates to the laying of charges and initiating legal proceedings; provides expert advice, in conjunction with TRCA technical staff and solicitors, to resolve complex contraventions of legislation; and establish strategic direction on matters before the courts.
- Supervises execution of remedial works as negotiated through settlement agreement, Court Order and/or Probation Order.
- Collaborates with municipal and provincial colleagues to troubleshoot and resolve complex enforcement and compliance matters in consultation with the Director, CEO, and legal counsel as required.
- Builds and maintains strategic external stakeholder relationships, working strategically with internal and external stakeholders, utilizing networks to establish and activate connections to achieve organizational goals and to explore new opportunities.
- Develops partnerships with municipalities, ministries, agencies to achieve successful negotiated settlements, and positive outcomes leveraging opportunities to overcome legislative constraints and tools.
- Leads a team of staff and ensures that team members understand expectations; communicates schedule, tasks and discusses priorities of items. Manages and assesses employee performance and individual team performance.
- Ensures resources are in place to manage day-to-day workload, providing immediate supervisors with recommendations for budget/resource requirements to meet future workload and project needs.
- Prepares annual budget for area of responsibility by participating in the planning process for cross-division/business unit / overall organizational budget process; ensuring financial plans are in alignment with the overall divisional plan. Monitors and completes required financial reporting and business/operational analysis.
What will you need to succeed:
Education (degree/diploma/certifications)
- University degree in Environmental Studies, and Natural Resource Law Enforcement or Police Foundations, or a related program
- Certified Inspector of Sediment and Erosion Control (CAN-CISEC), Certified Professional Erosion and Sediment Control (CPESC), or equivalent.
- Valid Ontario Class G driver's license
- Valid Standard First Aid & CPR/AED Level C Certification
- Successful completion of a Vulnerable Sector Screening or current Criminal Background Check
Experience
- 7+ years of progressive work experience managing compliance and enforcement; coupled with 5 years experience as a Provincial Offense Officer
- 3+ years of progressive managerial experience
- Direct enforcement experience with the Conservation Authorities Act and regulations including demonstrated experience with prosecutions initiated under section 28 and section 29 of the Act
Knowledge/Skill/Ability - Competencies
- Experience in the interpretation and application of relevant Provincial and Federal environmental legislation including the Conservation Authorities Act, Trespass to Property Act, Off-Road Vehicles Act, Occupiers Liability Act, Municipal Act, Environmental Protection Act, Endangered Species Act, Water Resources Act, Species at Risk Act, Fisheries Act, and other relevant legislation including the Provincial Offences Act, Criminal Code, Charter of Rights and Freedoms
- Advanced experience in conducting permit compliance inspections and non-compliance investigations with demonstrated knowledge of case law, procedures of law, rules of evidence and preparation of legal documents, including initiating legal proceedings (charges) in both Provincial Offences Act - Part 1 (Offence Notices) and Part 3 (Informations), preparing Crown Briefs, preparing and executing search warrants, statements, providing evidence and testimony in court.
- Influential communicator able to facilitate discussions between parties with different perspectives of competing interests and resolve conflicts.
- Ability to make sound and effective decisions under pressure
- Knowledge of Occupational Health and Safety Act, related Regulations, and legislation.
- Proficiency in MS Office suite including online software such as MS teams, WebEx, and SharePoint.
